I think the difference here is that the woman was definitely about to be physical assaulted and her life may have even been at stake. If he was just coming to steal, there's a chance she could have gotten jailed, depending on how (and where) things happened. There have been similar cases here in the U.S.

The differentiation stated here is right. In the US if someone was stealing a person's property and a person used deadly force to defend their property, that person using the force would be in jail as well.

A lot of states go by the theory that "your home is your castle". If someone breaks into your house, and you objectively (any person looking at the situation could reasonably see that you were justified in believing at the time you were in danger) and subjectively (you at the time honestly could reasonably believe that your life was in danger) reasonably believe that your life is in danger you have the right to blow them away.

That being said, you can not use deadly force to protect property. It is not valuable enough. If you use deadly force to protect property and you kill someone you will likely be charged with manslaughter or a lesser degree of murder.

You are also liable in civil court for any injuries that you make to them if you don't kill them. If you kill them you are likely able to be held liable to his estate for damages (wrongful death that sort of stuff). Best bet there would be to ask for a jury trial and get the jury to sympathize with you and hope that the judge doesn't grant a motion by the estate saying that the jury was swayed by emotion and the law and facts says that the estate should win.


These laws depend on the state of course, but that is the general way of looking at it among the states.

Depends on if you have the sign posted next to where the criminal broke in, and if it was well-lit enough to see. It's probably best to put a sign at each possible entry point, including on the roof, and put a little light on each one so it can be easily seen.

Depends on the state, some require it. Others allow you to kill them if they enter your house and you reasonably believe that your life is in danger.
