    I thought there were special rules when amending the state constitution were involved. An example would be in the post above for the Florida measure it is stated that 60% in favor is needed for it to pass.

    I was just curious if anyone knew.

    I think that's called super majority, where you need 2/3 of the votes in order to get a bill passed, but I am not an expert on FL laws.

    According to Wiki,
    "The United States Constitution requires a supermajority of two-thirds of both houses of Congress to propose a Congress-driven constitutional amendment; it also requires a three-quarters supermajority of state legislatures for final adoption of any constitutional amendment, a two-thirds supermajority of both houses of Congress to pass a bill over the president's veto, and a majority of the fixed membership to elect a President and Vice President (of Electors in the Electoral College, or if the election should pass to the Congress to decide, a majority of State delegations in the House to elect the President, and a majority of Senators to elect the Vice President)."

    This is now being explored as a possible out to CA Prop 8 - the two previous cases that went to the state supreme court set precedent that marriage equality was based in the state's constitution. This would mean that technically to change that basis, it would require a constitutional revision amendment, not an add-on amendment. Revision amendments require a 2/3 supermajority in both house of the state legislature and 2/3 supermajority of the popular vote.

    Expect to see this go back to the CA Supremes. And even if it doesn't, or if they dismiss such a case, this probably won't be the last word. I'd even expect to see a repeal initiative in two years.

    I hope this approach works. It makes me sick to think about everyone talking so much about equality for everyone and equal rights and how historic the presidential election is and then shit like this happens.

    It would require the same degree of turnout that we saw for the presidential election, which is nigh-impossible in a Gubernatorial race.

    Maybe in 8 years we'll get a gay president. We could have taken care of all the "firsts" in one shot had we elected a black lesbian muslim woman.

    Didn't we already go through this "Separate but Equal" bullshit in the 60's and wasn't it found to be unconstitutional and not allowed? Didn't that philosophy fail? Why do we have to go through this again every time with a new group of people.
