Apple: "No Reasonable Person" Should Trust Their Marketing

While every new Apple product is scrutinized closely by an army of ambulance chasers, taking issue with Apple's speed claims regarding the iPhone 3G is probably a somewhat reasonable position...unless you realize that Apple doesn't expect you to trust them in the first place. After a legal complaint by 70-year-old William Gillis over the "twice as fast for half the price" statement found in iPhone 3G marketing, Apple responded with a 9-page, 32-point rebuttal—one paragraph of which included this overly harsh, but very telling, statement:

"Plaintiff's claims, and those of the purported class, are barred by the fact that the alleged deceptive statements were such that no reasonable person in Plaintiff's position could have reasonably relied on or misunderstood Apple's statements as claims of fact."

In other words, if you believe what Apple says in an Apple ad, you are not a reasonable person. Well that point is more clear by the moment, isn't it?

For all the negative mudslinging Apple does against Microsoft, they really are no better. All you have to do is look at iTunes DRM, the recent admission by Apple that "No, we're not really immune to virus attacks, you need AV as much as Windows users do" and how fucking hard it is to replace a goddamn apple battery without sending it back to them should tell you all you need to know about them.

Plus I mean.. yeah advertisements should be taken with a grain of salt, but it still can't outright lie. If you advertise that your product does something and it doesn't, you should be held accountable. I'm talking reasonable, not that redbull can make you fly. The term "false advertising" exists for a reason.

But seriously, 3G is SUPPOSED to be way more than 2x faster than the EDGE network. The iPhone's 3G reception really is a huge pile of shit. It's hit or miss 90% of the time. Other people that have AT&T phones that are sitting right next to me get way better reception and speeds when we're on the exact same network in the exact same position.

I have yet to meet (physically, at least. Mayareira seems moderately open to it.) anyone who opts to use a mac and wouldn't defend it to the death. Most of their users tend to be stuck up pricks, from what I've met.
