This is pretty standard actually, it sounds bad when you take it out of context but it's a very basic principle of advertising. I'm no expert but I was a mass communications major, and we discussed this in some of my advertising classes. The idea that a company can make any claim they want as long as it's obviously not meant to be taken literally is a very old one. I'm not a big fan of that principle honestly, because companies pretty much get away with murder using it, but it's sound as far as a legal defense goes.
But yeah, this is really not an Apple thing, it's a general advertising concept that is pretty widespread. In fact, "no reasonable person" is pretty much industry standard language when referring to this idea, Apple did not come up with it themselves.
If I recall correctly, it's also how Larry Flynt beat the charges of slander against him about Jerry Falwell back in the day.
lol, funny that you mention it, that specific example was in our textbooks. Although that's not advertising, the principle still applies.

Well, the real issue here is in regards to 3g. The iPhone isn't 3g, so it won't have 3g speeds.
It's essentially 2.5g, but not true 3g.

I think this is a pretty legit case. When you use numbers you are basically quantifying something, and so your product should be able to back it up or else it is false advertising. It's like a car commercial that says a car has x horsepower but it actually doesn't...
