I heard the cop resigned voluntarily to avoid internal investigation, and the family is suing for 25 million. I won't be surprised at all if the cop will get hurt or die from "accidents".
Suprisingly, the cop is in the wrong this time. Although the accident thinking it was a stun gun is possible, since they kind of feel/look the same.

The last time I read about it, his attorneys (or the police rep) were saying he mistook his actual gun for his stun gun. Yea. I guess they noticed people stopped believing them about the objects they imagined were guns in the hands of suspects (off the top of my head: car keys, cell phone, PS2 controller, >CHALUPA<). Honestly, if a cop can't tell what weapon he is holding, he shouldn't be on the street. Even on the video that was linked, he clearly has it out and aimed for several seconds. On top of the fact the suspect was subdued and face-down.
One can only hope the police aren't providing him with protection.

The guy who got shot probably had it coming anyways. He put himself in that situation.
Based on all of the obvious, OBVIOUS people videotaping this situation as well as the reactions right after the gun shot from the officers and detainees, it looks like an accident.
Unless these are some really dumb ass cops who thought this shit wasn't going on youtube as it happened.
I've been hearing about this for the past week and apparently the cop had his gun on his right side and taser on the left or something like that. However they said before this guy tried to resist arrest the cop had pulled out his taser and put it back in the correct holster, so the whole wrong gun thing might be hard to defend.
Watching peoples reaction on this video and on the news is just unfucking believable though. There were riots because of this and morons were smashing shop windows and setting cars on fire. Then during the funeral for this guy the speakers kept praising how good of a person this guy was when he was already arrested for several other incidents before.
Then you got the reactions of these people on the subway. Before the dude pulled out his gun and shot the guy, the people in the subway were screaming brutality. What brutality? up until the gunshot the cops were doing their jobs but these idiots were rooting for the criminals.
based on the cops' reactions, it looks like a complete accident. I don't know the protocol for police officers in that situation though, so is legal action common here? I take the BART a lot and it doesn't surprise me at all you got all these fuckwits yelling shit at the cops while they are trying to do their job, making it a little more stressful.
Morons like the bystander just make it harder and a lot more stressful for cops. Fuck people
The "he probably deserved it" responses make me want to throw up. Trying to justify the cops actions after they've clearly done something wrong is idiotic.
There was no resist either, watch the video, Oscar just stands up and is saying something. He's obviously one of the leaders because the second guy stands up soon after and gets pushed down with him. They handcuff the second guy while Oscar is still talking. They attempt to handcuff him but push him down instead, using two officers one on his neck. After handcuffing him they think it's necessary to shoot him too I guess. Even if the officer thought it was a stun gun it was unnecessary as Oscar was already cuffed. Disgusting, that's cold blood murder.
Normally I like to give officers the benefit of the doubt as they put their lives on the line every day to protect us, but I can't in this case. He killed an unarmed man who was lying on the ground; that's fucking despicable.
