He didn't show up there with those things in his pockets, he got them from his truck, perhaps so that the cops wouldn't find them.

I used to think the same thing, till I was almost arrested for a warrant that I somehow had on my name. Turns out someone with the same name was supposed to get the warrant, and I got one instead.
I was in a bad car accident in which my car got totaled, I called the police, and the police ran my name and it came up as having a warrant. He handcuffed me as my wife was standing in the cold rain with no car and watch me get put into the back of a cop car.
I convinced the police it had to be a mistake since I've never been to county the ticket was in, and seeing my wife crying in the rain, they decided to let me go, but they were going to "Keep an eye on me".
If I trusted most cops to be honest about their mistakes and refrain from abusing this ruling by pretending to be misinformed in order to search without a warrant, I wouldn't be worried about this.
That said, in my opinion, we're fucked.
No offense to that JMC guy, he seems like the decent kind of cop who actually abides by the law even if he disagrees with it. I hope.
One day my LS outclaimed JMC's and he got mad and drove his squad car all the way to Akron to beat me down and tase me D:
As much as I agree with the principle of not letting criminals getting off on technicalities, I am against this. If it's cut and dry like this article is trying to say(which let's face it there is most likely some sort of a spin on it) I am totally against this.
You're going to want to get yourself a judicial clearance.
Warrants that result in mistaken identity will get you arrested time and again if you so much as get stopped for a fix it ticket. Call the courthouse the warrant was issued from and schedule a hearing to clear up the mistake and get the clearance (it's a piece of paper) that will say to cops 'fuck you that warrant isn't for me.'
BIG BROTHER
Really though, I'm not sure where I sit with this. I mean, they shouldn't be able to use illegally gotten evidence in order to convict someone, but its obvious that he was doing something illegal. But it sounds like the cop thought he was sanctioned to do what he did, due to the 'computer error', so I think this should fly, I mean there had been a warrant for him earlier, so its likely he had done something illegal. When it comes down to it, he did break the law, and he got caught due to a bug in the system. This sort of thing should not be habitual, but I think its justified in this case.
I'm not sure what the big problem is to be honest. Although it seems like most people here think that cops will now bust into random houses in the middle of the night searching for anything, I really don't think that is going to happen.
If you are going to be searched, chances are high that you did something wrong. And when they search you and find something illegal, sucks to be you I guess but it was your own fault. Is it really a better idea to let someone smuggle drugs/weapons/whatever no matter how shady they may be without a warrant?
Guess I'm gonna have to hide my weed a bit better.
Thanks for picking that apart, but you might want to include the sentence before that as well. The guy was pulled over by accident and searched, shit happens. If he didn't have anything illegal he would be fine if not a bit inconvenienced. Sadly he had illegal shit on him so he got boned, tough luck.
That's not liberty.
What happens when the law is passed for something you do have, then you say well goddamn I've got this sninkeldorfl and they are illegal as fuck, and back when they were passing tyrannical laws and disregarding the Constitution in the Supreme Court I thought it would never matter to me, guess I'll ju-
Oh, that was the Government, they are there to help.
The people should never have anything to fear from their government. The whole point of the fucking government is to enforce rules to keep its citizens safe from each other. He who governs best, governs fucking least.
