I thank you all for your suggestions and help even the ones that are apposing me.
I did agree to give it back but when shit hit the fan I wasn't concerned with anything but getting rid of the shit she gave me. In fact not only did the ring go but a very nice wallet went as well. If it happens to go further than her threatening me (Basically to the police paying me a visit and me going to court) then it happens and there is nothing I can do about it. The ring itself and if I recall what she said correctly is some silver or platinum band with an infinity sign engraved on the inner band. I don't know how much that would be and I probably should start looking.
Anyway thanks again for the help.
Youre a douchebag for throwing out something you said you would return. the only courts that would hold you accountable would be TV court shows. If you dont admit it anyways.
that being said, did she have sex with some other person while dating you? only thing I can think of to make this situation less retarded in your favor.
I apologize if the conversation moved past this, but I got stopped here.
This is not a bill for professional services. This was a gesture of faith and goodwill from one person to another. Even if the ring was perceived by both parties by anything more than a GIFT (which implies a passing of ownership), there is no receipt that the ring is in his possession, and there most likely is no proof that the ring was given to him in the first place.
Unlike an established company with an occupational license and storefront and history of busienss transactions, which would have receipts, order forms, and records of service performed and a market-acceptable rate of payment to be exptected.
Verbal contracts -can- hold up in some courts, but something as small as this would most certainly be thrown out of a small claims court unless there was stark proof of the ring's value and the transaction where the ring was loaned (not given, but loaned) from the girl to the guy.
The posters in this thread are getting too hung up on legality, and most of us are only armchair lawyers who've seen a few episodes of CSI and Law and Order.
Why don't you just call her and tell her that you threw it out and that you're sorry instead of being a total pussy about it.
Dunno why you would throw out a good ring, or even accept one that was her ex bfs, but nothing can really be done about it, there is no proof she gave it to you, and no proof you promised to give it back, unless you admit it
and..this just reminds me lol, i have a diamond/sapphire ring an Ex gave to me and he wanted it back. totally forgot about it, but i guess since this was 4 years ago, so has he
you didn't even read what I posted there did you.
Verbal agreements only hold up in court if the amount is in excess of a certain $ and not for petty shit like this. I can look up rq what the amount is, but verbal agreements are mainly upheld in contract litigation & for purchased. I guarantee you no judge is gonna care to uphold a verbal agreement between two teenagers [over a ring] that is due to a bad breakup
I was simply using that as an example of verbal agreements holding up in court. If everything was in writing there would be no need for small claims court. Disputes like this are why it exists in the first place. This will most certainly not be thrown out.
At first I was trying to address the facts as to why he should pay for the ring. I didn't want to get into armchair legal advice. I also didn't want to berate the guy for doing something stupid during a breakup, which is why I stuck with the facts.
I am also not gonna go into the source my knowledge. I have nothing to prove to you guys and frankly don't care if anyone takes my advice.
It's a ring, holy shit. What are the cops ganna do? Probably laugh at her. "Your ex wont give you your ring back and you want us to leave the station, follow you to his house, and tell him to give your ring back?" They'd prolly taze her for bugging them. I would, at least :3
This. Pick one and move on. No cops are coming to your door, and the odds of you getting summoned to small claims court are exceptionally slim. Even if you do, god forbid you have to pay $200 for some shitty ring that some ex-bf gave her.
Only question I have is: How old are you?
How about forgetting about your legal obligation and just do what any decent human being should do.
Despite what she can prove in court, you know that an agreement was made and you should honor it. If you tossed it out then ask her how much it was worth.
Forget about the reasons why you two broke up and all the other extraneous crap. None of that changes the situation. You made an agreement and you should now do what you need to do to make it right.
You could think of it as punishment for being a dumbass who accepted a ring that some former boyfriend gave to her to wear.
Post how you replied to her emails! If you replied in a way that makes it seem like you knew of the agreement, then good luck, sir!
If it was silver, you are out at worst like $150. If it was platinum, you are out a whole lot more. Considering how stupid this exchange is, I would assume it was a silver band, and you can shut her up forever with like $200.
Sometimes though, it's easier to just not be a douchebag. Keeping It Real™ is for suckers.
200 bucks is a fair trade to get her off your back. Crazy bitches are crazy.
