    In some instances when someone is arrested they will use a lesser charge initially, then modify the charges in a future court date before the trial once they have all the evidence.

    Actually, anything that wasnt premeditated is not considered 1st degree murder. Acts of passion (as this probably was) is 2nd degree.

    2nd degree = I lost my temper and god smacked you with my axe. (act of passion/anger)

    1st degree = I detailed a 10 page plan to execute you 3 weeks before I murdered you. (act of intent/planning)

    3rd degree = Oh shit, when I pushed you down at the bar because you grabbed my wife's ass, you hit your head and died. (accidental or non intentional death caused by the actions of the defendent).

    varies from state to state. California just has First degree and first degree with special circumstances.

    * The first scheme, used by Pennsylvania among other states:

    1. First Degree Murder: A premeditated murder, and (in some states) murders involving certain especially dangerous felonies, such as arson or rape, or committed by an inmate serving a life sentence.
    2. Second Degree Murder: Non pre-meditated killing.
    3. Third Degree Murder: Any other murder (e.g. when the intent was not to kill, but to harm the victim)

    * The second scheme, used by New York among other states, as well as the Model Penal Code:

    1. First Degree Murder: Murder involving special circumstances, such as murder of a police officer, judge, fireman or witness to a crime; multiple murders; and torture or especially heinous murders. Note that a "regular" premeditated murder, absent such special circumstances, is not a first-degree murder; murders by poison or "lying in wait" are not per se first-degree murders. First degree murder is pre-meditated.[68] However, the New York Court of Appeals struck down the death penalty as unconstitutional in the case of People v. LaValle, because of the statute's direction on how the jury was to be instructed in case of deadlock in the penalty phase.
    2. Second Degree Murder: Any premeditated murder or felony murder that does not involve special circumstances.[69]

    Some states, such as California, simply preserved the old distinction between two degrees and have no offense called third degree murder. They simply have "first-degree murder" (leading to life in prison with a possibility of parole) and "first-degree murder with special circumstances" (leading to death or life without the possibility of parole), while second-degree murder continues to be the default category (punished by life in prison with a shorter term until parole eligibility).

    Other states use the term "capital murder" for those offenses that merit death, and the term is often used even in states whose statutes do not include the term. As of 2006, 38 states and the federal government have laws allowing capital punishment for certain murders and related crimes (such as treason, terrorism, and espionage).     Another case goes on to prove that religions in general are pernicious. Prayer is selfish in the sense that it's self-comforting and not actually doing anything tangible to make any situation better. Churches are just an archaic real-life facebook that provide people avenue for social interaction. Rational thoughts or morality that comes with a set of dogma and religious baggages, your choice.
