I once served for an officer that went to court for child abuse due to spanking his kid after said kid attempted petty theft at a store. Not as severe as what you mention, but honestly, perhaps it would be best if you didn't give anyone ideas at this point? *sigh* The kid had no markings or the like on his skin ~ the child merely mentioned to his school teacher that his father had spanked him for the act and it exploded from there. It was a real shame to watch someone I had a lot of respect for go through that. The officer won the case, unlike this one, but the fact charges were filed will still be there, and his authority as a father was undermined by this sordid affair.

About the case. This would not happen in the US, at least not in a sane court. So long as no harm is being done to the child, the courts can't interfere with parental rights of raising a child. Not sure if the fucks in canada have this, but anytime during a divorce situation, any children of the couple are assigned a Guardian Ad Litem, a lawyer, social worker or trained volunteer to ensure that the childs best interests are met. They report to the court only.
