    The one they identify with or are most comfortable with.

    That 14 year old boy who got a sex change or whatever probably identifies most with a girl, however previously he more than likely wasn't able to use the women's restroom out of comfort (of social norms, not of with himself) or out of societies rules. Now that he's a girl he more than likely both identifies as a girl and is most comfortable with being a girl
