    Update: Her bf calls me this morning saying that she's pretty bruised up (obviously), has a cut on her foot since she was wearing flip-flops and she's spitting up blood, yet he hasn't taken her to the hospital yet. After discussing with my parents on what to do, I tell him that I'm going to make a police report and let insurance handle it, but he'd rather settle for $125-$150. Seriously wtf? You say your gf is spitting up blood and you wanna settle for $125?? Is this guy yanking my chain or should I seriously consider his offer?

    For the record, one of the posters in this thread reassuring you is a police officer. On top of that, I've visited the courtroom for a variety of cases myself, and I've been on both sides.

    They walked away from this. The cops reassured you that you'd be fine, and gave you all of their information. Don't get this put on your insurance record.

    Definitely don't give the guy money, because then you're just asking to be blackmailed for more money. You would be a complete sucker if you took that offer.

    pay him the $150 and get her to sign a release of damages or w/e the proper term is, just saying that the settlement of money is the final action and that no other actions can be pursued having a 3rd party witness it if you go this route.

    They'll fuck you for far worse on shit that isn't your fault. Raise your premiums and all sorts of stupid shit. Report the guy to police and don't pay him shit.

    Go file a police report, tell them officers responded to the area and said you were all set (they can look up who responded if you give them a date/time/location). Seems like this is nearly a blackmail attempt. If she was injured with internal bleeding (coughing up blood), she would have started it not too long after the accident. Generally speaking... no one waits a few days for a ER visit if they are coughing up blood.

    This x 1000. Once you give them money on your own, it screams to any other 3rd party that you believe you did something wrong. It'll cut off any leg you have to stand on. Just tell the guy you've thought it over and want to make sure you have all your I's dotted and T's crossed and are making a police report before you settle.

    If he hasn't taken her to the hospital, then the whole thing is b/s. I didn't see anything on whether or not she damaged your car, but take some pics of any dents and contact legal aid. Whether or not you qualify for it doesn't matter, it'll prevent them from being able to use legal aid against you and have to pay for a lawyer that they probably can't afford. It's dirty pool, but it's better than having to sit in court for some b/s that's not your fault.
