Minors have all rights accorded to the constitution, the only contest in this arena is if schools have the right to suspend those rights on school grounds.
Legally the answer is no, but it's one of those "the supreme court won't take the case cause no one wants a final answer" situations, since many politicians believe it would cause chaos in schools if children were allowed their full rights.
My father wanted me in a social environment again; I was literally cut off from civilization living 2 hours on foot to the closest town. My dad was always at college and couldn't really bring me anywhere.
I have no qualms about starting late; if I hadn't, I probably wouldn't have remembered how to act around people in reality. I literally always did schoolwork for an hour, and played FFXI or EQOA for about 12 hours straight every single day.
After he finished college we moved to a more inhabitable place (You know, where I could see a person without walking for 2 hours) and so we put me back in HS. I was angry they would only accept me as a freshmen but I really didn't have a choice.
Anyway, OT: I probably won't sue, yeah, it was just in my mind because my Civil Law teacher had actually mentioned it a couple weeks prior to this happening that if he was ever suspended for something as ludicrous as saying swine flu he would probably sue.

No, I really didn't have a choice. When my father wants something, he gets it. If he wanted me to go to a public school to be back into a social environment, it happens. It doesn't matter what I think. He doesn't CARE what I think. My mother is long gone, and so it was his choice. If I combat him on anything, he goes to really far lengths to make sure he gets his way.

No matter what the situation, it is not a breaching of your 1st amendment rights since you are in high school, or middle school and under the age of 18, you really don't have any of those rights to begin with. So yes you can get suspended for just saying swine flu, and if you did bring it to court you would also have started a clear and imminent danger in a classroom, disrupting the schools goings, so they have all the right to suspend you. Enjoy the time off bro.

I teach in an upperclass school in south Orange county. The students and the parents have more money than they know what to do with. I had a student who was expelled for smoking weed on campus. This kid paid his lawyer (who he still had on retainer for his sexual harassment charges filed by another student from the year prior) to argue with the school administration about whether or not he could go to Prom at the end of the year.
The school I work for has been sued over content on student's myspace pages that is derogatory towards other students.
Legal action is certainly not something that schools in my district take lightly.
Speaking as a high school teacher certain things are taboo in certain schools and districts, and carry a zero-tolerance policy.
To bring this home to your case specifically, the swine-flu epidemic has produced quite a stir in our district, and several parents have been hesitant about sending their students to school. If a school has an outbreak of swine flu (or is even rumored to have an outbreak of swine flu) it could lead to a significant loss of revenue to the school if enough parents keep their children at home.
Just from what you've said here, it sounds to me like your teacher handled things poorly. Unless he was acting under direct instructions from the school administration (which seems unlikely to me).
