    Alternatively:

    SE has established a successful and well recognized history of non-MMO, non-fee-based, games, called "Final Fantasy #". Someone purchasing Final Fantasy XI could (and i agree, they'd have to be a fkn moron) say that Square Enix used the precedent set by all previous Final Fantasy games to deceive a consumer into purchasing Final Fantasy XI, for which they would then incur a monthly fee, and then all associated fees/consequences that accompanied refusal to pay the initial fee, because they were deceived into paying it because of how the game was named.

    It's questionable and hinges on the plaintiff being able to prove that they had no idea that FFXI was an MMO and that SE would charge them every month for playing.

    Edit:
    Confusing the issue even more is the whole PlayOnline aspect of FFXI, as a person could argue that they thought they were signing up for PlayOnline services, not Final Fantasy XI, since PlayOnline is not exclusive to FFXI. Again, for someone not familiar with the PoL/FFXI relationship, PoL might as well be an entire other game. This doesn't even take into account the relationship with Tetra Master either.

    No offense but it was a stupid case regardless if she won it or not. The dumb bitch put the coffee cup between her fucking legs and squeezed it to where the lid popped off. All Mc Donald's is at fault for it not having better lawyers at the time to explain that some people are stupid as shit.

    Coffee is supposed to be hot when you drink it. Why the fuck would you put a hot drink in your crotch in the 1st place?

    Right we should have waited for the proper law suit where it would have spilled off a table and onto a four year olds face and permanently scar someones life. Then we all would have been happier and it would be normal temperature as well. Mc Donald's had it coming to them, this was only the catalyst. You don't keep your stove at 1000 degrees and then when people melt their fingers on it tell them "Stoves are supposed to be hot your fault" now do you?

    Seriously, as much as I love the game SE created their QA has been atrocious and as we're paying for the service monthly it's incredibly bad business. Something like this has been a long time coming. SE needs to settle the case and then toughen up their QA to a human-level standard.

    It's not a company's responsiblity to tell you that when something is hot that you're not supposed to touch it. If you didn't grow up not knowing or not being told that something is going to burn you if you touch it, then it's your fault.

    Mc Donald's & almost every major company even now has people trying to sue them for stupid shit even with warning labels all over their products people still try and put out stupid lawsuits. The woman was a dumb bitch for putting a hot container between her legs regardless if she won the suit or not. All this did in the end was fuel the fire for stupid people to sue for the most stupid shit because they don't want to be held accountable for not having any common sense. No business out there is trying to drive away their customers but it's sad that a lot of them have to pamper to a select few people who really don't have the sense to know "Hey if I put a hot cup of liquid between my legs, it's not my fault if I get burned right?"

    Fire is hot, knives are sharp, and ice is cold. If you don't know that crap by the time you're 8 then you're hopeless.

    Now don't try and translate that I'm defending SE in anyway because they are playing by a whole different set of rules. They want customers but they're doing a shitty job of trying to keep them when they have an amazing level of shitty customer service.

    All coffee brews at the same temperature. The hot water that feeds the machines in your average Starbucks is at 200 degrees fahrenheit so that it can quickly steam up through the auto-drop machine and brew through the ground beans.

    Coffee straight out of the brewer is always around 190 degrees fahrenheit. The whole "but it's best to drink at 142" has nothing to do with the brewing practices. Consumers want hot, fresh coffee, and letting a pot sit around for 20 minutes to cool off is a waste.

    That's why coffee never got any cooler in retail establishments after this nonsense. Companies were allowed to put a "Caution, dipshit, this is HOT" warning on the label/cup/sleeve/cap instead because you can't just brew coffee at a lower temperature. It doesn't work that way.

    Lady had good laywers, refused to settle, and got media attention. It was right when frivolous lawsuits became popular, and it was a right place, right time, burnt asshole situation.

    Oh geez, this case always comes up as the classic example for frivolous suits when there are much better examples (and actually frivolous)

    a) She was asking for her medical bills to be paid off (less than 200k if I remember). it was the Jury that awarded such ridiculous money. As a result of the Jury's incompetence, McD's appealed and got that sum lowered significantly (not enough to cover her bills). They were still held liable though.
    b) I guess you guys have never had coffee spilled on you. Try it one time. It hurts. But it won't give you third degree burns. The lid had melted off for crying out loud.
    c) Putting warning labels and dubbing this woman an idiot in the people's mind was excellent PR on behalf of McD. They took what shoud have been bad publicity and turned around where they were the victims. (guess what, warning labels don't protect you against law suits, cue the tobacco industry).
    d) The average wind speed of a swallow is 30 miles per hour.

    a weird thing happened to me about two months back as well. I was not billed at all for the month and only for my purchase of ACP, the following month I was billed for two months. I have the same credit card i've had on the account since i've returned around a year ago now? Its no big deal to me seeing as they didn't charge my account for one month i half expected it was a glitch and they would charge me later in the same month or just correct it during the next registration server/payment cycle.

    A lot of people, including myself, hate SE's craptastic customer service. I have been double billed a few times myself the past few months for no apparent reason. (CC not expired, no cancelled ID's, ect.), it pissed me off, but I don't think trying to squeeze 5 million out of them for their service is reasonable.
    The long term effect of "what could happen":
    Let's say this person actually wins all 5 million dollars.
    Doubtful. But again "it could happen".
    That's 5 million dollars out of SE's pocket that they pretty much have to pay.
    It takes money to make FFXI work. It takes money to pay their lolemployees, it takes money to pay for the servers, it takes money to pay the electric bill to keep the servers running, you get the point.
    The long term impact, that things like this actually does have the potential to bankrupt a company eventually, then those of us who do get some enjoyment out of playing this game, loses out.
    SE definitely needs a wake up call to their customer service department, they should listen more to the players, ect. but the potential to bankrupt them doesn't really solve anything, and can ruin the company to the point they can't even pay to develope future games.
    I agree with SNK on this. Some people are just fucking retarded.
    It says right on the box it's online and has "applicable fees apply" or something to that effect.
    Even my 6 y/o knows you have to pay to play. It's not rocket science.

    If its a class action, the $5 million would be split among everyone affected by whatever SE is found at fault for. So, its actually not that much.

    It happened..

    I was charged a total 27 dollars. 25 bucks for the transfer to Bahamut that I PAID FOR LONG TIME AGO and 2 dollars for a mule I have not used in 3 years.

    And I had deactivated my account last year in October and came back last month.

    WHAT THE FUCK?

    Edit: Well, its not a big deal >_>. They didn't charge me for May and June so it only makes sense they charged me for both of those months.
