Misdemeanor/felony/etc isn't a degree of penalty, it's a classification of a crime. Your charged with a Class A, Class B, Class C, etc long before a penalty is handed down. Now, you do base your penalties off of those classifications, but the classifications are ultimately derived from the varying degrees of the crime (4th degree assault, 3rd degree assault, etc). I guess you're both right, something is either illegal or it isn't...it's binary, but at the same time, there's a set of classifications written very clearly that determines the degrees of illegality.
