It doesn't make it any less of a crime if she gave it away. The only saving grace is that it wasn't spent on further illegal activities, like drugs, weapons, or funding more schemes. That's probably why she got the minimum sentence, not because the judge thought giving it away was a noble sentiment.
Besides, how do they know she didn't bury it in the ground? 1 year in jail is a small price to pay for $340,000. She can just go dig it up when she gets out. And she'll need it, too, because no one is going to hire her after this.
