Then it's a good thing there are lists like this, so we can keep a close eye on them. Especially if they are inclined to rape more kids to go back to jail, as you suggest, that just means they cannot be trusted and an even closer watch must be maintained. Perhaps ankle bracelets for life?

At least other people will be less inclined to decide to rape a child, knowing their life will become a living hell and they will be unable to be a part of society ever again. When a reasonable person weighs the pros and cons, the risk and rewards, they will decide it's not worth it and forget about the idea.

As for those who still choose to do it, just keep vigilant. After serving their time, they will be unable to commit more crimes to go back to jail because such a close watch will be kept on them.

Besides, if your complaint is about the list, that's not what keeps most offenders out of work. When you apply for a job, you are required to say whether you have been convicted of a crime before. Even non-sex related stuff. So if this list weren't around, they'd still be out of work and we'd be in the dark about who to protect our kids from.

The "registered sex offender program" is fucked up because it was tacked on an additional punishment retroactively to crimes that were committed before the law went into effect - in essence altering the initial punishment as ruled in the court in which they were convicted. In my mind it's a violation of double-jeopardy for anyone who had committed a sex offense before the law went into effect (mid-90's).

Personally, I have never heard of a criminal who has done hard time committing a crime after leaving prison because he has difficulty functioning in society afterward for whatever reason.

The list says whether it was rape, molestation, or something else. Would you fire your lawnmower guy if he was on the list for taking pics of his kids getting out of the bathtub? That discretion is up to you.

Besides, for most normal jobs where you apply and check the box saying you've been convicted of a crime before, you get a chance to explain it. Just write you took pics of your kids, the employer can verify it, and if he doesn't see "RAPIST" stamped on your public record, you're good to go.

The point being, if it's rape, it'll say rape, if it's molestation, it'll say molestation, if it's cybersex with kids, it'll say communication with minors for immoral reasons. But if it's "other crime" or whatnot, you can ask about it.

However, all the major sex crimes that people are actually concerned about are explicitly labeled. So if it doesn't say "rape" or "molestation", you know it's something else. It's up to you to ask about it, if you're ready to fire them over it.
