Just stealing the information is a crime, and yes..The law can go after them, however EGS having the credit card information stored and not encrypted is a big issue for EGS as well.
Both sides have many areas that could cause them much trouble and if I had any second questions about being in that database, I would start causing a lot of issues for both sides.
..I do however blame EGS much more for not keeping their stuff a bit more secure, but anyone who knows me knows I have felt that way for a long time.
Nothing like running a small internet business while cutting as many corners as possible..Just waiting to get hacked. lol.
I don't know what CC info they'd have exactly, EGS does everything through paypal and third party payment management last I checked.
Update [A few days late]
The issue (which has already been presented in this thread) is that the owner of EGS (Monarch) hasn't paid some of the people who were operating the website. This doesn't come as a surprise to me after having interacted with the upper management a few times. I actually stopped using EGS a few months ago because of how seedy everything was getting.
What's happening now is at least one former EGS Middleman (Bassline) copied the database that EGS was using for record keeping and is now threatening to get every account that was ever sold through EGS banned if Monarch does not comply and pay them. There are probably more people than just Bassline involved, he's just the only person I've spoken with about it. The 'hacking' that occurred is almost certainly related to all of this (i.e. former site operators copied the forum database or something.)
It's disappointing to me either way. Monarch might be human garbage, but getting hundreds of accounts that belong to completely unrelated bystanders banned in an attempt to exact revenge on him is just sad. It's not going to fuck Monarch over as much as it will fuck over all of the people who have nothing to do with this shit.
Also, just to clarify, I don't think that any of the EGS operators have committed a crime by downloading the database. Monarch never had a business license, he was never operating EGS legitimately (tax evasion and the like.) He GAVE them access to it, and since he never had a legitimate contract with them to begin with, it's not data theft or unauthorized access. Reporting Monarch to the IRS for tax evasion and possible fraud would be the best way bring him to justice, if that's what their goals are.

I would imagine if SE was gonna go and ban people based off information retrieved from a database that was compromised, they would've done something to the people who were using FFXI-App when Taj hacked that database and posted the list of all the players and servers of people that used it. They didn't.
Taj had names, what he guessed (well not 100% guess as used FFXIAH to help) what servers they where on.
bass has POL Logins and CD keys etc, what you would only give if you where selling an account and knows the servers and toons name on the accounts...

If you loan me your credit card to use and I give the number to someone else, that is illegal. There is a USC for it but I don't have time to look it up..

Also with this "RMT isn't illegal" bit, its not a criminal act, however you can be taken to civil court.
I wonder how many people keep checking this thread to see if those logins have been publicly released yet, so they can try to jump on a random EGS account and trade all the shit possible to themselves before time runs out...

My girlfriend has info on people's accounts, including CD keys, two different people, who still have their accounts. She didn't buy them, but one person's account was compromised, and he didn't wanna deal with getting it back, and she volunteered to handle it for one person. That person gave her all the info on account, including CD keys. Another person needed a PW reset but the account region was NA and the person was out of the US because of military duties and she has his information as well, including CD keys.
In the end, it is hear-say in both situations.
This is what I believed, although I'm not so sure based on the testimonies of others. Some have claimed that if you call SE with all of the account information that cannot be changed (name, date of birth, PoL ID) that you can get the account banned by saying that you sold it to someone else and that you want it back. I've never done this myself, that's just what I hear people say. I am highly skeptical though.
