If they wanted to get everyone banned, they'd just need to release the POL IDs/PWs and any registration codes they have. SE is pretty lazy, so this might not get people banned if they just post it, but I'm sure if they sent enough copies to them then it'd eventually get done.

SE explicitly states that the accounts are not the possessions of the players and that they cannot change hands. SE isn't the law, but I don't know if you any explicit rights to your login/password regardless of how much you paid for it and they certainly think you've got no right to it if you bought it. If SE does all the bannings (entirely in line with the TOS), then I'm not sure what you'd legally charge Bassline with. All EGS sells is account info, gil, and items.
If you wanted to go after any one legally, it would be the person who sold you the account data as it was not there to sell. To sell a product you most own it, but the product (accuont info) was not there's but property of SE. So the person in the legal problems is the seller.

Bassline could be in legal problems if he gave out the CC info correct, but so far has not and think he is smart enough to know not to.

What legal action could SE even go for against those who sold their accounts though? They could reclaim the money the account was sold for?

SE could just ban the account, its not illegal to sell an gaming account. But breaks the terms and agreement.

The buyer has a case as your not allowed to sell something you do not own.

Right, then the sellers wouldn't even be affected so noone is affected legally.

The sellers would be effected they could have legal action against them.

You buy a car from some one, this person had the car on loan from a hire company. You drive off with the car thinking you got a sweet deal, then you get a letter saying the car is going to get taken away and given back to the hire company. You can not take the hire company to court for your money back from buying an item that was not allowed to be sold you go to court against the person who sold you the car.

    Makes more sense?

So what legal action could be taken against the sellers? A fine? A jail sentance?

Depends on the location of the buyer, and the amount can be down to a small fine but with some accounts selling for the thousands a judge could bring it under the wire fraud law what can be up to $1,000,000 fine and up to 30 years in prison. (Most accounts that were sold over $1k I would presume come under wire fraud instead)

Huge lulz I am having either way.
Just because its wrong VS the TOS does not mean in the US it matters, TOS has nothing to do with US law. All this means is that SE can ban the accounts on their servers. Most law has yet to define who owns the rights to accounts, but we all get pissed when someoen gives our info out so ya ~_~

That's what I was trying to get, but let's be honest, SE isn't gonna bother doing any of that shit when it took them 5(?) years to get Maury to close down FFXAPP.

Laws of sale and ownership do though and the person does not own the account in the first place to have the right to sell it

Maury did not make millions, the RMT market is 258M a year. The value of 1 years of RMTing accounts (if had no costs of getting the accounts) would bring in more money then 5yrs of FFXIAP (RMT is a 258m a year+ market) whislt 3rd party apps is no where near 1-2million

If they publically post the login info, could people potentially go onto the billing section and pull personal information of the owner? That would be one thing that might actually get the police involved.

Also, keep in mind most of the accounts sold on EGS since 2007 probably can't be accessed anymore because they've had security tokens added since then.

Passwords where not given out and the CC info is removed when you do a MM transaction. So even if passwords given out the CC info is removed

We're talking purely account sales here, and solely FFXI accounts, that is nowhere near 258M a year, where FFXIAPP would have taken in around $400,000($20x20,000 FFXIAPPs ever bought I read somewhere here)? and account sales over the years to be probably 1-2M?

yes it gives you a lot of info in the log in if you have account info

    1) name
    2) where you live
    3)CC inf(last 4 so i guess nothing big there)
    4)Phone number
    5) a shot to use the CC to buy random accounts/add ones and what not.

nasa was 2k per server, one sold on like 50% the servers.

FFXI app sold 100's per server I would guess? maybe 1000's+? do not know the numbers

    still this does not mean shit about how much the guy mad,its about this guy stealing others info, its like the old story that was floting around;

a store owner went away, he came back after a week off and the store was broken into. again next year he did the same thing. the store was broke into again. the next time he took time off he put a lion in the store it bit off the leg of the guy breaking in, the robber sued the store owner and won.

There were at least 300+ FFXI-App per server, or at least I believe 300 was the average.
Standard NASA was $2000, which could hold up to 10? people on the bot, vs. Unlimited NASA which was $4000, and can hold as many people as you wanted. I'm sure my numbers might be a bit off, but not by much.
