There's a difference between stalking and harassment. I think the two are getting muddled here. The timeline also seems muddled from OP.
This is what I understand:
- You broke up in May. (It's mid-November now, btw, how long did you go out? You're 20, can't be that long.)
- You talked last month, even as recently as two weeks ago.
- You have been texting her every 1-3 days at the ungodly hours (to most people) of 3-5 a.m. Does she work? Does she go to school?
Stop being so fucking emo. You were harassing her with the texts every 1-3 days at those hours. Someone doesn't have to say, "hey, you're harassing me" for it to be harassment. It doesn't have to be acknowledged by the harassed party for it to occur.
I think you need perspective. When you break up with a girl in the future, for fuck's sake delete her from your contacts, block her on Facebook, etc. Men & women who have dated in the past aren't meant to be friends, let alone best friends, no matter how much you think that will work out, it won't.
Sounds to me that he's being charged with harassing the mom, and that the mom is a huge fucking bitch, throwing away his stuff that he lent to her, and then running to the police on some bullshit.
There's harassment and there's stalking. He wasn't charged for stalking, to bring it up is absolutely irrelevant.
Right, the cop informed me it was only a misdemeanor and that any further contact would increase the charge to stalking aka a felony. I'm not tard enough to send her a text message even saying 'hay thanks for the jail time I'll never talk to you again'

It sounds to me like he got into a petty back and forth with her mom, some of which he's detailed, and when he went for the gusto (talking about her daughter fucking her new boyfriend - totally valid given that she threw away his NES IMO) her mom couldn't handle it and ran to the nice policeman to save her.

Online harassment can be charged as a felony. Watch your ass on facebook, MSN, etc. Eat the misdemeanor, while it's sort of a big deal, it's onyl as big as you make it. I'd put it behind you asap.
had the texts been sent between 3-5pm as opposed to am it'd be harder to argue they were harassing. However sending repeated texts while people are trying to sleep, is in fact disruptive, or harassing. Also, sending texts to a mother and discussing her daughter's ability to cum was most likely the straw that broke the camels back.
