Online harassment, while much harder to prove, is a felony, a much higher degree of crime. Just because it's a text or phone call doesn't mean it isn't a slam dunk. You're trying to tell the kid to fight the equivalent of public intoxication. The kid admitted to it, he can go to court, say he's sorry, and probably get out with probation and a restaining order. Or he can fight this, drag it through the mud, and potentially end up in jail for a year and at a loss of a large sum of money.

someone correct me if I'm wrong, but at the time of the incident he stated he was 18 (or older) and she was still 17. If I remember right doesn't matter if they dated, it would still be considered harassing a minor, so that might be the reason for it being taken seriously.

The police cannot make an arrest without evidence. If he was arrested the night after the "pwning" phone call that's hardly enough time for the police to contact the phone company and build a case against him.

Cursing at someone over the phone one time and sending a few text messages is not harassment.

Funny you pointed that out because an aunt of mine in Warner-Robbins, GA who is married was receiving unwanted advances from a guy and was recommended to pursue a restraining order, and if he broke that they could file criminal charges. This carried on for 6 months.

Oh I admit to several assumptions made and clarified by saying in earlier posts "assuming his story holds water." Which is why I recommended a lawyer and am getting pushback for.

text messages 1-3 days a week for 2-3 weeks saying "hey I miss you let's talk and sort this out" is not criminal harassment.

It can be cause for pursuing a restraining order, yes, but not criminal harassment. It's not criminal harassment when some douchebag that got my phone number texts me once or twice a weekend with "whats up bro what u doin 2nite?" "anything good goin on steve?"

Funny that you of all people would say that...In texas, only one party has to consent to the recording (ie...the party doing the recording). Don't know if you're a sports fan, but this came into play when Roger Clements recorded a conversation with Brian McNamee regarding the steroids investigation.

Don't know about GA though, only reason I recall the texas legislation was the Clements case. I used to do the whole law thing at the University of Louisville before I had a kid and dropped. That's the reason I know a lot of irrelevant law information. Spent a few summers at a DAs office.
