Funny that you of all people would say that...In texas, only one party has to consent to the recording (ie...the party doing the recording). Don't know if you're a sports fan, but this came into play when Roger Clements recorded a conversation with Brian McNamee regarding the steroids investigation.

Don't know about GA though, only reason I recall the texas legislation was the Clements case. I used to do the whole law thing at the University of Louisville before I had a kid and dropped. That's the reason I know a lot of irrelevant law information. Spent a few summers at a DAs office.

Not all states require consent of all parties. GA does, which was why I mentioned it. I also remember the Clemens case.. Gotta love TX.

My understanding of sexual harassment is "Its okay to do anything verbally/written/electronic communication-based once, but if they ask you to stop and you continue, its sexual harassment," so it leads me to follow that regular harassment is along the same line - if you do something unwanted, they express to you their desire for you to stop, and you continue, its against the law.

My friend got a restraining order for non-stop texting his ex-gf he struggled to get over. She had the phone company block his calls, but couldn't get the texts blocked, and she had to get a restraining order against him.

It goes state by state, but most require that the person know they're being recorded.

Either way, he is still an old friend that I have tried to help before, but it's hard to get him to listen. Yesterday he read that post and talked to me on aim calling it ignorant, and then said how half the people on the forum were ignorant, and then how almost everyone is ignorant.

I'll clear a few things up. Lots of people are misunderstanding the whole mom and me part. The only time I've ever contacted her mom willingly was after I remembered about my NES and its 50 or so games. I called their house, no one answered, I wasn't surprised. So I text the mom and I say:

me: "hay, I would greatly appreciate if you could return my nintendo and all the games I let taylor borrow way back whenever."

She responds: "haha we threw it away cause it didn't have a power cord, tough luck!"

A few more back and forth text messages proceed after this some of which were me being abit angry at her throwing it away for something easily replaced. It was a short conversation nothing harassing.

The second time I came in contact with her mom: She contacted me via text message at about 6am this past sunday morning. It was a long conversation. It went back and forth for a good 1.5hours or so. It was relatively good but in the end after her constant persistence of trying to 'reach out to me' I shut her down one more time before she began to heat things up as mentioned in previous posts. She lashed out first, I'm not one to stand by and take things lightly for too long. I have patience just like everyone but it runs thin.

As far as the whole being arrested thing. It has come to my attention that the whole thing was false accusations. Basically it was a she said he said type thing resulting in me being charged wrongfully, arrested AND booked for 6hours with absolutely no proof. I am astonished that just because some crazy psycho bitch calls the police and says 'this kid is harassing me' things turned out the way they did. As of right now the charges haven't been dropped because they're still pending an investigation I'm assuming. However my point is that I was placed in jail with absolutely no evidence what so ever. The basis for my arrest was solely derived around her saying I was harassing them.

It's becoming a different type of ordeal. I am really curious as to what's the text book rules on NOT reading a suspect his or her miranda rights because I was not at any point given them. The only thing the arresting officer told me (and the only thing anyone else told me) was "you're under arrest for harassing communications" or something like that.

Well there was another thing I was told. I was told that the family had 'proof' of me actually stalking my ex girlfriend from a text message though they were unable to present. I was told I sent a text message telling her I knew where she was what she was doing and what time this took place. I literally laughed out loud. I said "haha I sent a text message to my ex girlfriend and said "hay i know where you are and what you're doing and btw it's 9oclock!"" The lady says "I don't know the specific details but I'm just telling you what I've been told"

Continuing, though everyone in this thread has the complete and utterly retarded wrong idea. Especially those who actually agree that I was 'harassing' her or her family. I shouldn't have even been placed in jail. They shouldn't have even been able to hold me because at the time (I'm assuming they have some sort of text message they're thinking of twisting around to make it seem like I was doing said things above) they had absolutely nothing on me. At the time I was booked all against me was a lady saying I did something.

I sat in a holding room with 4 other people 3 of which were never booked and were able to make a phone call to post bail. Though I was forcefully booked and was unable to make a call until after I had all the shit assigned to me and was in a cell not of my own but accompanied by 3 other guys. (methlab maker guy forget what it was called he said, armed battery assault and armed burglary) Ontop of all of this I found out that the family that pressed charges has relatives at the jail. Thus leading me to believe something far more.

I guess I should wait for some feedback from the oh so great BG I love to turn to. Don't disappoint.

edit: one of the people who was able to make a phone call and wait for her mom to come post bail without ever being booked was charged with burglary. So I really find it stupid that I went through all of that when it was a simple 'harassment' charge. I really think her relatives had something to do with this. He was a little pussy in highschool and has never liked me since my ex and I broke up.

That and if he was arrested without a warrant, they could have just subpeona'd him, without probable cause or evidence then he can turn around and sue the state and complainant for damages.

A night in jail over text messages and a phone call ( if he's telling the truth ) is pretty dramatic and cruel and unusual punishment. You don't go to jail if someone wants to serve a restraining order against you.

You can be arrested and held for 72 hours without ever being charged for a crime. After 72 hours the law is required to either charge you with something or release you.

So yeah, they are well within their rights to come to your house in the middle of the night and haul your ass to the cooler without a warrant, probable cause, or fuckall, for 72 hours.
