The rule is designed so that the offense actually has to play through the defense, rather than simply kick the ball over everyone's head to a well-placed striker camping out by the goalie. It's an anti cherry-picking rule. Plus refs (as you can see) get a large amount of latitude when it comes to calling people offsides.

Not only that, it's not usually the ref calling the offside. There are linesmen on the side of the field that will raise their flag if they deem someone to be offside. The only person with a whistle is the referee though, so he can choose to allow play to continue if he thought the linesman was wrong. I haven't reffed myself, but I'd imagine that most of the offside calls that are very tight would have the referee looking to the linesman (unless he's close to the play).

But throughout the qualifiers and even before (in the summer), Ribery was a sub. Yes, he's been made out to be injured, but has been playing for FC Bayern.
