Not a lawyer/judge/paralegal but I do have a degree in Criminal Justice. I can almost certainly guarantee you she has no case provided you gave an accurate account of what transpired between the two of you.

    1. Does she has physical proof of your recommendation (official prescription?)
    2. Did you explain the benefits of the console or just went for the lulzfatbitchdosumsports?

    1. If she doesn't have physical proof and this is indeed your second time, just say you learned your lesson with the first lawsuit and never did in fact recommend it to her, that knowingly working at a lesser income hospital you knew she couldn't afford it and thus never did recommend it to her.

If you don't want to lie, then just go print out some studies proving that wiisports contributes to weight loss and whatever else health benefit comes from it, and that you were solely recommending it as an alternative solution to gastric bypass (which she probably wouldn't have the dough for anyway)

As said before, that pig is probably using you to get some more money to spend on KFC and get even bigger, so just get a lawyer and shut that bitch up. If she does win this, I've lost faith in any justice system. Shit is retarded

    1. Did you discuss "alternatives to surgery" or did you just say, "Here, take this instead," as you handed her a Wii-Fit.

    2. How exactly are you able to prescribe and then hand out Wii consoles and Wii-Fit games as a medically-approved treatment.

At best, that sort of thing would be similar to physical therapy, which would require coaching and a plan for improvement, no different than weekly PT visits at a therapy clinic. If they have any sort of case against you, it would be that.

However, based on what little you're describing, this seems like an attempt into your malpractice premiums to make a quick buck.

My advice is to get malpractice defense attorney. If you don't know one, talk to some collegues in the field.

Sounds to me like she is just a lazy bitch that doesn't want to actually do anything to help herself. Its obvious she is lazy seeing that she just wants to take the easy way out and get gastric bypass rather than actually doing something that could be more beneficial for herself like diet and exercise. I really don't see what you did wrong. Isn't it standard practice for a doctor to recommend less invasive alternatives before turning to surgery.

All you have to do is appear in the courtroom and tell them you're a medical professional and your recommendation was for her to exercise more if she didn't want surgery. Knowing that she owned a Nintendo Wii, you recommended Wii Fit as a means of getting started and advocated an alternative diet. You should not be sued for someone taking offense to a medical recommendation. People go to the doctor for a solution to a condition, not for a shoulder to cry on.

Bitch needs to stop fucking whining if she's that fat.

Lastly, if you have finished your residency and you're not prepared to be sued by every patient that comes through your doors then you're in the wrong profession.
Nothing wrong with that, also I don't really think an unemployed middle aged woman on free state insurance, has any means to cover the expenses of an elective surgery. Luckily I don't work there full-time and I just go when they're short staffed.

Either you are leaving something out or this is the dumbest fucking thing I've ever heard of.
Not leaving anything, and this is the second time this has happened, different patient.

Showed this to a friend who's in law school and he laughed.

Sounds like her lawyer(?) (whoever handed you the paper) is trying to intimidate you. But yeah, if everything you've provided is accurate to how it occurred, she has no case.

This sort of begs the question as to why you're prescribing these in the first place. Do you have medical evidence on their effectiveness in any capacity? Are they approved by the AMA?

If Morbid Obesity is a recognized disease, I'm not sure you can prescribe Wii-Fit as a viable alternative to surgery. At the very least, something like a structured diet-and-exercise plan with professional coaching is needed.

Wait...this happened before? As in same situation of patient wanted surgery and you suggested WiiFit?

Unless you said something unprofessional/condescending when giving your advice, I'm seriously confused right now.

You should probably stop prescribing wii fits obviously.

Isn't the weight limit for the Wii Fit board 300 pounds? ;/

Regardless, I'd have told the fat gnome to get off her ass and do a 15 minute job every day to start with rather than them thinking surgery is going to keep them skinny for the rest of their life. (which is what I'm assuming they wanted to get done given their BMI is way off the charts)

simple google shows that it wouldn't be unheard of for doctors to prescribe a wii-fit.

I handed her a wii, I don't know if your hospitals do this or not but we've been giving them out to rehabbing patients and overweight people. I told her to come back tomorrow and I'll have one for her free of charge(I was trying to be nice.) 2> I told her the benefits of doing it in the comfort of her own home.

    1. Yes, discussed alternatives with her.

    2. This specific hospital doesn't do that but back at Greenwich general we give them out all the time. I was willing to hand deliver her one from where I work full-time and get this in return lol. I've given these to rehabbing patients. It's not like I said "No surgery for you, use this fatty." I said "there's alternatives to going under the knife, maybe we should give this a try first, be back tomorrow to pick it up free of charge."

I haven't been in the field that long, I'm still a "toddler" so to speak. Wasn't expecting this type of a turn out from ungrateful people.

I imagine Greenwhich General has a legal counsel you can talk to. I suggest doing that. It doesn't sound like much, but handling this inappropriately would really screw with you, especially given your new-ness to the field.

Well the first patient almost had a case, I learned my lesson. This time I'm sure I didn't do anything wrong, I was as professional as one could be prescribing an overweight patient a gaming console.

If you are a doctor aren't you required to have very expensive insurance that covers lawsuits like this and will hire you a good lawyer? Honestly of all the bglegal questions posted here this one seems the most pointless. More like you just want to share the lol story.

    Get a good lawyer really.
