Really not going to feed the trolls today. I figured since people post all sorts of stupid shit on here why not ask a serious question, maybe for some useful advice?
I'm pretty sure this isn't the last time this will happen but I doubt I'll be coming down to these parts anymore. This just ruined my day.
You said...you loved me Kyo ; ;
I don't see how what I was saying is trolling. You asked a serious question that goes beyond the type of serious question that is appropriate to ask here. If you are a doctor then the hospital or doctors office that this event occurred in should help you out. Hospitals have lawyers that will advise you.
Further if this is the second time this happened then you should know what to expect.
Like I said it seems that you posted this story just for the lulz of someone suing you over the advice you gave them to try wii fit to get in shape and be healthier. You couldn't really expect any useful advice here (no offense bg legal) beyond "go see a lawyer".
Are you a doctor or a nurse? What is your profession exactly?
Have you bothered to go talk to the administrators in the hospital you work for?
Bold 1: Like I said, I don't work there I'm filling in as a favor for a friend who's backed up on his work and needs a hand with consultations and random walk-ins. I was told since I don't officially work for the hospital that I'm not covered under their malpractice insurance and since what I did wasn't hospital protocol it's my problem not theirs.
Bold 2: Doctor, majoring in cardiology.
Bold 3: No, but I will once I get home going to see what I can do, I have no intention on setting foot inside a court room. Court appearances = bad rep, no one wants to be operated on by a surgeon who's been in court on multiple occasions.
Also, would like to apologize for the snapping, today has been an all around horrific day and I just can't wait to get home.
This guy must be your lawyer since you have to ask /bg/ for legal counsel lol

Dr. Maddox: Hey, how come all you have in here is a smiley face button and a revolver?
Ted: Well, one's in case I get sad, and the other one in case I get really sad.
As many others have pointed out in this thread, it really sounds like she doesn't have a foot to stand on. It seems (google search) that prescribing the fit is an alternative that many people are taking up for weight loss. You can't sue someone because your feelings were hurt in this country, in fact, suing someone based on Libel or Slander is very hard to prove as in most cases it's all open to interpretation.
I'm curious though, how long did it take you to get issued a summons from the she walked out of the office? The way you explain it makes it seem like it happened very shortly thereafter, I don't know a law office in the country that would take on a case like that in a matter of hours and file all the proper paperwork with the courts to get you that very same day, much less with a case as weak as this one.
Also, what grounds is she suing you on?
Well shit.. so all I had to do to get a free Nintendo Wii was go to a Hospital and whine about being obese? God damn, I could have saved 200$!
Have to agree with what someone else said about her being a lazy fuck and not wanting to work for it and just want surgery. Despite the fact that Wii Fit would probably be a much more reasonable answer than ANY kind of surgery. Any surgery runs a risk of complications from anesthesia/etc.
Either that or looking for free money.
Just.. lol.
Well that clears that up. As long as you are aware of what is really necessary here. In the future is there proper protocol to follow if you decide to fill in as a favor at another hospital? There must be a way for you to work for free but still be covered by their insurance or something. Also usually individual surgeons and doctors (and even nurses) have to have insurance maybe it is different in your state but where I live (Nevada) my friends wife who is a nurse has liability insurance to cover her if something happens to a patient she is helping with. At least that was my understanding of it.
I'm no lawyer or too familiar with medical malpractice issues, but are you being sued for "insulting" her or for going against hospital protocol?
I still feel like she's got no leg to stand on, but if you went against the hospital's protocol, maybe you are getting sued because you didn't follow protocol and told her to come back the next day for the Wii. Maybe that somehow equates to insulting her by not giving her care or something crazy like that.
Oh fat people strike again.
Being sued on grounds of her being insulted, I just sat to read all of the wording in the document, apparently the word "obese" struck a nerve.
I hurt her feelings and it was unprofessional of me to do so by offering her a wii after calling her obese. Not even directly calling her obese even lol.
anyways this will not stand up in court you gave your medical opinion obese woman is stupid woman.
I would be more worried about being sued for a negligent referal.
The WiiFIT has a 300 lb weight limit. This is due to how much the load bearing devices, scales, can withstand during apropriate usage without damage resulting. Someone who is over 300 lbs runs the risk of breaking the product, and/or injuring themselves simply by operating the device as in a manner which can be considered reasonable use.
But, bitches be crazy... especialy the overweight ones.
And women are not very bright when these things are concerned. They probably would not even take the fact that their lard ass might be too damn heavy for the scales used in the Wii FIT. So, you probably wont need to worry about a law suit pursuing for this line of rational.
Yeah, I can't see that standing up in court because it sounds like she's definitely obese. Medically, I've been "overweight" all my life according to BMI charts, but that's just my body build. My doctors have definitely said quite bluntly that I fall into the overweight category medically, even though I'm not exactly a fatass in the least.
I doubt you have much to worry about, but again, I'm no lawyer so I'd make sure to get on decent one and I'm sure you'll be fine.
On an aside though, your bedside manner might just very well suck (not trying to insult, honestly) and whatever comment had "obese" attached to it just struck a wrong nerve when you meant no harm.
Live, learn, get a good lawyer on retainer.
As a Certifed Fat Fuck™, I am allowed to say the following:
You should have prescribed her a mirror instead. Fat people that can't handle the fact they're fat should just be allowed to die. As Carlos Mencia said "Be fat and happy, or go lose some weight." Obese is a medical term and if she can't handle the truth, the only thing she should receive is 50 cc's of "shut the fuck up you stupid cow whore".
If I was offered a free fucking Wii for being fat, you goddamn right I'd take it. I'd hope for a little more guidance than "It's dangerous to go alone, take this". But it's a goddamned free fucking Wii you stupid cunt, just take the goddamned thing.
And never would I sue a doctor for telling me the truth that I know and obviously recognize since she was looking for the surgery. Like that would keep her healthy anyway without something to restrict her from overeating afterwards. Not to mention how gross the extra skin looks (although that would be an issue either way).
God forbid you offer her a safer and medically preferable, as well as long term solution. Get a good lawyer and take so much from her that she starves til she's thin.

I just hope it doesn't turn into one of those "The hot coffee is too hot, so I am suing you." I know what it's like to have your kindness shat on in a hospital setting, really I do. Implications of (morbid) obesity is fine and dandy, it's no secret to anyone when you're 300+, I do wonder if you were not discreet about it (you said it was in front of other patients in a lobby?) Even then, I don't think it would hold water. If you're acting in accordance with your training (and being rather new), I don't think it could get anywhere. But then there's the whole "adherence to all rules, regulations, and policies while providing care in the professional setting" that they might try and exploit. I hope all goes well for you though :/
perhaps she fealt that walking out of the office, to the clerk and past everyone in the reception area, while holding a Wii FIT was insulting.
Did you explain to her the dangers of surgery and the cost involved? If you told her that Gastric Bypass surgery had risks involved and should only be used as a last resort to diet/exercise I don't think you will have a problem winning this.
The fact is that it is an elective surgery (unless medically proven necessary) and that as your doctor you explained that there were alternatives and offered the Wiifit as one of the possible choices.
With 99% of the patients/clients out there you have to explain most things to them as if they were 3 years old.
