Not trying to hijack the thread, but I was going to make a similar topic:

Last Sunday I wrote my ex a check post dated for Monday since my direct deposit wouldn't kick in until Sunday at midnight. So the fucking bitch changed the date on the check and took it to some check cashing place and cashed it on Sunday causing me to overdraft with a bounced check fee, and continual overdraft fee after I went to pay the rest of my bills. It's gotta be some kind of crime to forge a date on a check right?

Did you write the check in pencil or something?

There has to be some sort of law against what she did.

You wouldn't know that though because you've demonstrably never picked up a book nor educated yourself on the matter. Let me guess, overweight housewife?

If you want it investigated you'd have to talk to an upper person. Reason being what she did is fraud. Which was stupid however, because most (and I think all) banks state in your agreement state that banks can and will cash future dated checks. It's not like illegal to future date, but there is nothing to stop a person cashing it before the date. So technically, she didn't need to forge it and could have still cashed it.

Sounds to me like you're more likely to get in trouble for writing a postdated check than she is for depositing it.

even if your ex didn't alter the check, banks will still accept it.

    http://www.bankingquestions.com/chec...ostdating.html

There is no law that prohibits the issuance of a post-dated check; however, there are laws against issuing checks when you know that you don't have funds to cover them. Whether a particular state's bad-check law would make an allowance for the fact that a check was postdated is something you need to check in your own state.

Delivering postdated checks is not wise, however. That's because it's legal for your bank to pay a check even when it's postdated, unless you've taken the extra step to contact the bank and put it on notice about the postdated check, and requested the bank not to pay it until its date. From an operational point of view, this creates almost exactly the same work for the bank as a true stop payment order. For that reason, you may find that your bank will charge a fee -- often the same as its fee for a stop payment -- for handling a watch for a postdated check.
just wanted to clear up that post dating a check does jackshit. (though altering - in any way - maybe illegal. i dunno)

Does the out-of-state bank your (OP's) check is from have a branch in your state, as well? Or do they only exist in the other state?

Nah, I don't buy anything I can't afford. Though while we're on the question of credit, do I actually have to wait to be billed to get credit, or can I buy something w/ the CC, go to the site and pay it off w/ the debit 2 secs later, and have that count for paying off a CC? if not, I have no plans to use it at all.

You can pay it off immediately if your CC offers free online bill pay (and if it doesn't offer that you shouldn't have a CC with them anyways, so I'm assuming they do). Certain transactions (like paying for gas at the pump, which I guess isn't an issue for you) will take a few days or up to a week to post to your account though.

Ah kk. Someone had said it wouldn't count towards my credit if I didn't wait for the bill and make show I could make monthly payments, ect. But yea, I'm not dumb enough to spend money I don't have. Strictly for building credit while paying it off immediately, no longer than the same day tbh

What do they mean by "count towards credit"? If you mean to increase your credit score, as long as you're not late it wont count against you. They'll report it to the agencies as being in good standing and never late, etc (I can't remember the exact words they use). Your credit report will basically say that you've had a credit card for x amount of time and have always paid on time. So it should still build credit regardless, unless your friend knows something that I don't.

Credit reports don't even show what kind of schedule you pay on. It just says how long you've had it, your maximum credit limit, and I think it shows the biggest balance you've ever had at one time (though it may just show the biggest amount you've ever had at bill time, which for you would say zero. In that case I guess it may look as if you've never even used the card. But I don't think this is how it's reported). I'll have to look at my credit report when I get home and see how these things are reported.
