Can a landlord terminate a lease based on loud sex?

The possibilities of this thread are endless, but hopefully I can get my question answered somewhat before the fun begins.

Basically, one of my housemates is a screamer. She screams and squeals a lot during sex. It sounds like a piglet stuck in barbed wire honestly. For the record, she's asian.

I, along with my other housemates, have learned to tune it out... or at least use it for a little hand action in some cases (kidding of course... or am I?)...

My landlord isn't so good at dealing with it.

Last night, I got a phone call at ~midnight. He was furious at the noise coming from her room (directly above his), and demanded that I tell her to stop. I hate being that guy.

He also mentioned "it sounds like a calf is getting slaughtered".

He also is insisting that she switches to another room, and the only person she could switch with is me, due to furniture/stairs/etc... The other alternative, he says, is he breaks the lease.

I'm totally up for the room swap, for the record, because:

1: She has a bigger room...
2: ...and a bigger closet.
3: I'd just as soon muzzle my bitches, so that'll take care of any screaming on my end.

Anyway - before the fun begins... Can the landlord terminate the lease based on this?

Depends on the lease; read your rental contract. Most leases have some clause in that defines procedures based on "Disturbing other tenants," and what the landlord can do to you in regard to any potential disturbances. This will probably vary from lease to lease, hard to give legal advice without the contract.

I would suggest reading up on your state's tenants rights laws and speak with an attorney about possible actions.

I wouldn't hire an attorney just yet as the landlord is probably unaware of most of these laws (because most landlords are retarded and think because they own things they can do w/e they want) as well but loud moans is a noise violation so he does have grounds but it takes like 3 months to evict someone for the most part i think (learned from word of mouth) if he gets the notice and etc.
