    Rear ended by drunk driver, advice?

    I was stopped at an intersection at a red light and was rear ended by a vehicle that was going about 45mph. The guy seemed intoxicated and when the local police showed up, the driver of the vehicle that rear ended me was taken away in an ambulance. I wasn't able to get a definite answer on whether or not he was drunk.

    Anyways, I was driving and my friend was in the passenger seat. The car is pretty much totaled. We are both fine, walked away with some minor (or at least I hope so) whiplash.

    Im not sure if the guy who rear ended me has insurance. The officer told me it would be in the police report but as this occurred earlier tonight, I have not gotten the report yet. Im not sure what my insurance covers as my parents deal with all that.

    Any advice on what I should do? This is the first time Ive been in an accident. I just feel like Im gonna get screwed here, as the vehicle was not worth that much in the first place.

    you will just get a check for the blue book value of your vehicle

    and sue for the whiplash

    I'll get the whiplash checked out tomorrow. Im sure my neck will hurt a lot more in the morning.

    A few things:

    Pray or wish or hope upon a lucky star that the guy has insurance.

    You and your friend should probably each see a doctor - a 45mph rear-ender is no joke, nor is the very real whiplash you may be feeling over the next couple days or weeks.

    And probably...encourage your parents to look into getting a lawyer, especially if the doctor determines that you have any injuries of any sort. If the guy has insurance, I would assume that legal firms would jump at the chance to take your case.

    I know this advice is boring, but yeah.

    and btw, your neck is fucking killing you.

    Don't settle for any preliminary bullshit from his lawyers until you find out exactly how bad your whiplash is, and how much it'll cost in total. Too many people settle early, just wanting the issue to "go away" and thinking that their minor pain will always remain minor.

    Go to the doctor and get checked out, asap. If you have personal injury protection on your auto-insurance, it will pay for it. Also, don't use the term whiplash when you talk to anyone about it. It's a red flag that you are trying to get money, not saying you are, but yeah.

    My friend had it a bit worse than me (pain in his right arm). Think he is going to the hospital near by in the morning, so I'll go with him and get checked out.

    Honestly, I'd go tonight, I'm kinda surprised the medics at the scene didn't encourage you to do so.

    Both my friend and I were fine for the first hour after the accident. I didnt start feeling anything until a few hours afterwards.

    I actually walked to the hospital, but they were really busy, so I decided not to wait.

    Unless he had insurance I don't think there's much you can do, but you have to wait on the police report, and then call your insurance company to see what they say.
