    If you have decent insurance (uninsured, underinsured motorist etc.) gather all the paperwork you can get from the wreck, doctors vists etc. and hand it over to your insurance company. They have full-time lawyers who are well versed in this crap and will legally rape this dude.

    I'm not sure how it is in the States, but in Canada, you have 2 years to make a medical claim on your insurance, so even if you're not hurt right now, don't sign off on anything, until your time limit is up, because something could come up within those 2 years.

    I was in an accident last August where an idiot ran a red light doing about 35 mph and t-boned my car. For me, the pain didn't really develop for a day or two, so you may not yet be feeling the full effects. Definitely get yourself to a doctor and a physiotherapist that specializes in motor vehicle accident injuries. They can assess your range of motion and strength (and pain levels) and can give you stretches to do at first and then strength-building exercises to get you back to as near-normal as you can.

    I recommend advil or aleve type meds for pain, and you may want to get a heating pad if you don't have one. Massage therapy will also be a big help. I'm of the opinion at this point (over six months later, and I'm still going to physiotherapy) that whiplash never goes away completely, but you will become much more aware of your posture and anatomy over the coming weeks

    Don't worry so much about your car at this point - just make sure you take care of yourself first. The person who rear-ended you should be paying for everything, and as others have mentioned, don't sign anything that says you're fine and don't need any treatment until a year or two has passed and you really are back to normal.

    My mom get T-boned by an Frontier Truck (Phone Company) when it ran a stop sign. She figured she just had whiplash as well, but the lawyer she immediately called recommended a large battery of tests.

    Turned out she had multiple pinched nerves, 2 slipped disks, and some other nerve problems.

    Bottom line it turned her $10,000 soft tissue settlement they were pushing, into a $1,000,000+ judgement.

    Now if the dude that hit you didn't have insurance, your more or less fucked on the lawsuit end. Save everything from the doctor, if it turns out the guy does have insurance you can and will be reimbursed for your copays as well. My parents have $500 Hospital Co-Pays so that shit added up fast.

    Get a lawyer regardless once you have the police report. And definitely get your ass to the doctor ASAP.

    Was he wearing a condom? Drunks rear end a lot of people and are often too plastered to use protection, so you should probably get yourself tested if he wasnt.

    I work in Medical Billing, and here is the best advice I can give:

    As everyone else has said, see a doctor! You will probably get referred to a Physical Therapist. If your insurance has PIP Coverage (Personal Injury Protection), they will pick up the bill. If they don't it is then generally billed to your regular Medical Insurance(if you have insurance) once your regular insurance finds out you have no PIP.

    The most important thing you can do is GET AN ATTORNEY. It won't cost you anything until the case settles, and an attorney will do things like request records/bills from any doctor visits you had, etc - to cover the full amount of all of those bills, then generally more to cover any other expenses. Like I said, it doesn't cost you anything until it is all over with.

    I got hit by a drunk driver on Christmas day 2007, the douche bag tried to run too. He was uninsured but my insurance picked it up at no cost to me or my premium. And both my friend and I were able to sue him for our injuries and the remaning amount on my new RX8 ( of course the remainder of my car payment was actually for "Inconvinience and car rental fee's")

    Yea, the guy that hit me was knocked out for a few minutes. When he stumbled out of his vehicle, he tried to tell me that he needed to "go over there and use the bathroom"

    I didnt let him leave.

    You will not get "rich" off of an incident like this. He or his insurance company will have to cover any and all medical bills that result from this accident as well as any vehicle damage or replacement. Only in the case of serious injury or death could you directly sue someone for a large amount of money. In your case it sounds like you are going to be just fine.

    If I were you I would file a claim with my insurance company and have them contact the insurance company of the person at fault. That would probably be the easiest thing to do in your case.

    In your case it sounds like you are going to be just fine.

    Herein lies the problem. Neurological problems don't necessarily metastasize until weeks, possibly months, after the accident. I'm talking about legitimate problems here, not insure scam bullshit.

    Like I said, my mom felt fine aside from the "whiplash" feeling after the accident. After a couple weeks the pain got a bit worse. After a couple months she could barely walk from the the pain.


    Also, if you do get a chance to sue this douche bag, I'll give you a heads up now his insurance company will hire a PI to track your ass around to make sure you are actually injured as well.
