Usually the plaintiff who is suing proceeds only when they feel that they can win, I don't think SE will gamble on a case where there's a chance it will lose.
Companies have sued for alot less then that. Plus there's this really awesome little thing that lawyers do now where they have the losing party pay all thier legal fees. So basically this is a non-issue at all if SE wins.

I don't think the playerbase will care if they lose 75-150 botters per server. Read this whole thread and you can get a general sense of what people think should happen to botters.
