That's looks like a golden silk orb weaver. On the off chance that you actually manage to piss it off enough to bite you, their venom is no real threat to humans. Orb weavers are pretty useful in fact, they make awesome webs that they never leave across large openings, so if it's not in your way, you can let it just sit there and control the local flying insect population.
