He seems to interpret the proposed law as 'foreign babies get no birth certificates.' This doesn't strike me as realistic but I wonder if any Arizona lawmaker has the jurisdiction to override an unambiguous and fundamental Federal Law by issuing a 'non-citizen's birth certificate.'

    Holy fucking shit.

Guy, people aren't granted passports and birth certificates from mexico with a phone call. There is guildlines when you're abroad. So unless you can

    A. you can prove you are who you say you are to the Mexican Embassy

    B. Can provide documentation that says the kid is yours.

According to this. You need to provide documentation to prove who you say you are in order to get a Legal DNA test that is admissible by law.

I'll say again. kind of defeats of purpose then doesn't it? considering being illegal means you have no identification.

None of that means they aren't mexican citizens - which is the only point I'm making. If you're saying "they're technically mexican citizens but it would be very hard to prove it" - fine, I'm right there with you champ.

In an e-mail obtained by our sister station in Phoenix, Pearce writes he plans to "push for an Arizona bill that would refuse to accept or issue a birth certificate that recognizes citizenship to those born to illegal aliens, unless one parent is a citizen."

Can I be Irish Archi? I have Irish relatives and since you're passing on citizenships just by mere proclamation I'd like to be Irish.

    Make it happen please.

Right, they wouldn't have an American birth certificate - I gotcha.

They'd still have parents. They'd just have a documentation issue to deal with. It would be harder to prove their situation - but it wouldn't make them not Mexican citizens.

Eh was checking something similar that is happening between Spain and Bolivia, Bolivia just approved a law where kids of bolivians born outside are considered bolivians, so Spain is now not giving those inmigrants the spanish nationality, they need to ask for naturalization.

Spain says that they used to give them their nationality before because United Nations ask that every person in the world to have a nationality and Bolivia didn't have that law until now.

Who will recognize them? Mexico wouldn't recognize them because of the 'documentation issue'.

And the children wouldn't be legally allowed to leave the US because they have no documentation. following along?

This part is meaningless when it comes to their legal citizenship in Mexico - and it's not as if illegal immigrants haven't figured out how to, um, cross the US/Mexico border without dealing with authorities.

If it came to a legal issue, a Mexican judge would determine the citizenship of the parents and order a DNA test, proving the child has a Mexican citizen as a parent.

The kids are legal mexican citizens, whether it would take a while for courts/authorities to realize this truth is another issue. You act as if all children are born in hospitals and get birth certificates immediately. A friend of mine was born in El Salvador, at home, she didn't get a birth certificate until she was 6 years old. She was still an El Salvadorean citizen that entire time.

And Illegals can get Permanent resident status if they go through proper legal channels yet they don't. I wonder why that is.

Maybe its because of the court costs and fines they would have pay to get it done would make them poorer then they already are? Or maybe its because of the drawn out process?

Or maybe... Just maybe..(hear me out for a sec)

    Spoiler: show
    It's both

If they don't bother getting documentation for themselves because of the expense what makes you think they would go through all this trouble for each kid they have? use some Critical thinking.

as for your El Salvadorian friend. That was by choice he/she could have gone to El Salvador and gotten a birth certificate within a week.

You are expecting too much from a mexican judge, if they are as bad as ours, that can take years, hell who is going to pay that DNA exam, i don't know over there but in latin america they are really expensive.

El Salvador must have shitty laws, because when i was born in Colombia my dad went to register me and got a birth certificate next day. ( i have Venezuela birth certificate too btw)

Also you guys are talking like only mexican were illegal over there , don't forget the rest of latin americans that travel illegal and some of those countries may not have a law to protect those kids (just like Bolivia approved that this year)

How would she have proven she was the child of her parents?

Are you implying they'd probably just take the parents' word for it?

Oh I don't know maybe her parents could go to the nearest municipality and use the registrar office in.... El Salvador.

this might be kinda hard to believe but most people in third world countries don't live on farms. Even if they did they could prove who they are when they are in said country. All they would need is witness to the birth were talking about Illegals living in the united states. Illegals who don't have access to the Registrar's office in the hometown in Latin america.

So assuming they attempted to legally leave the united states (via a controlled border) the kid would be stuck in America until a judge court-ordered a DNA test, which would prove the child was theirs and a Mexican citizen?

    Pretty much.

So until then the child would be a ward of the Taxpayer.

The beauty of all this is this wouldn't solve the illegal immigration problem this would actually expand it because now every child born doesn't need to cross over to be illegal all he needs to do is be born. Illegals aren't going to stop having children all of a sudden lol

This has nothing to do with Illegal immigration more then it has to do with fear of the changing demographic in this country.
