I will open this long post with answering to a few of your statements.
Also the post before this came off really crappy I did not mean to put you down or try to in anyway... lol its what came out of my mouth in the car(using vlingo lol) I really do want to apologize for how that came out
Not at all the same. As I stated vlingo created this style of voice powered app and tech way before both apple and samsung. Samsungs S-voice looks nothing like siri. Although it does act somewhat like it(as per code? I could not tell you) In this suit its like Disney is going to sue someone for tom and Jerry; forgive me if Disney owns the rights to it lol I am merely stating that a creator of something was copied(in this case Vlingo) by Apple. Apple made a patent for said style(siri a copy of Vlingo voice assistant) even though it was not their idea in the first place.
Odds are Vlingo will not do anything to back its rights because the iPhone is a major part of their money. Much like a song you own your IP as soon as you wright it down(or even can prove that it was your idea first)
I side with you that both apple and samsung have nothing to fear at all in the short run. However a business does not really care about the short run. Its motives are always in the long run.Apple sold 37 million iPhones in Q4 alone, and we all know that iPhone 5 will cause just as much presales and hype as all the other ones. Shaking...yeah, from the strain of carrying that $10,000,000,000 profit to the bank last quarter.
37 million is great. However the 9million pre orders is even better in this case. That's beat out both the Iphone 4 and 4s in pre orders. A major number.
over 50 million SGS2's where sold, and 7 million Notes(grated that 7 million sounds low but thats over 57 million phones sold)
Now I understand that is to date(I cant find the numbers for q4) but a number we can pit against each other are the pre order sales figures. The Iphone 4s had pre orders of under 4 million Samsung over 9 million(and this is not even including the US pre sale figures).
Yes for now both samsung and apple will have strong sales. Apple has its backing as does Samsung now. It does not matter if they have a failure of a phone or two. The money will roll in.
now onto the more important matter at hand and why I am claiming Apple is scared(or should be)
basic economics tells us that the more market control you have the more market power you have this equals selling power and buying power.
In other words although apple could sell 100 million phones at some point and turn profit; if on the other side we have Samsung selling 200,000,000 apple is now behind Samsung. This does not sound bad, however we have seen this with apple in the past. Apple owned a huge portion of the tablet industry making it next to impossible for others such as Samsung and Motorola to enter into the market. We herd on more then one occasion that a android tablet had to be delay because of a shortage of display's due to apple buying them all.
Apple has been the front runner for a long period of time. They have controlled the industry and dominated it at the same time. As their market share drops they will not be able to control the price as much. A major factor the iPhone has the largest mark up for any phone per money spent on it in smartphone's the iPhone 4 was at a 100% mark-up the iPhone 4s was priced at less then a dollar difference in price to make Under.
Lose market share(even if you show crazy profits) you lose control of the selling and buying power. It really is a domino effect. Even a front runner such as apple needs to fear this. To brush it off is business suicide in the long run.

As for the presales, you are still not comparing correctly. The number you are mentioning is US only presales for the 4S, and comparing that to international numbers for the SIII. Since Sammy tends to do the opposite of Apple (Sammy tends to release international before US market, and Apple is US first) it's really hard to get a hard comparing of their pre-sales. We will know more when the US pre-sales of the SIII comes to light. And to be honest, it would be more correct to compare those numbers when the presales of the iPhone 5/The New iPhone/whatever the fuck it's called start. Granted, looking at the feature list of the S3, it does seem like they are trying to compete against the 4S....but trying to beat up an 8 month old phone really isn't a fair fight. This is supposed to be Sammy's chance to get "ahead" of Apple. So let's see if they can get ahead of the iPhone 5.
Also understand that Apple normally only has presales for a few days at most. iPhone 4S was available 10 days after the announcement. So we are talking a very small presale window. Compare that to SIII here in the US that is getting over a MONTH for pre-sales. So again, it's really hard to say "Look at all my presales!!!" when it's not really on the same level. We will have to compare actual sales. But I can tell you that in 2012, Q1 and Q2 have combined for over 52 million iPhones sold.
But even in the long term, neither is in any trouble, neither is going anywhere. They will both laugh all the way to the bank.
As for the "virtual assistance" issue...you do know Vlingo was bought by Nuance, creaters of Siri, right? So with that went all the patents. Number one reason why Apple has the legal need to address these patent issues. BTW, Nuance is essentially the same company that created Dragon Naturally Speaking, the first real usable voice software, and holds all those patents also.
And it isn't suing just for the look, it's the technology behind it and just the whole concept of the "conversational personal assistant" Again though, Patent wars has zero to do with who created something first, it's all about who was smart enough to get and own the patents. I could create something revolutionary, but if I don't secure the patent before somebody else, I can't do shit about it later.
SGS sales to the EU was given less time. so we can somewhat look at that. EU sgs3 sales vs US iphone sales.
You also jumped right past how samsung is gaining momentum and that and business would be crazy to not be scared. I did side with you and say for the time being both are going to make tons of money. That is not how business looks at this though. They see a competitor creeping up on them and they have to do something. Apple wants the lead, without it they lose their power to produce the insane profits they have put out. Lose the lead and you lose everything I told you. Facebook posted billions in profits, but think about how at its current value it would of taken far more then the normal IPO's of 11~15 years to be worth hat 100billion. Investors look more then a few years ahead; they look to see where the company might be in 1,5,10,20 years. Samsung overtaking them is scary for apple. I dont fault them for defending the look(like they have done in the past) I fault them for taking something that was not theirs to defend. Vlingo does not car so apple should be be sued nor should apple have the power to sue samsung
as for vlingo/siri/s-voice. Lets look to other types of IP. Like I used before a song; if I make a song wright it down and eminem was to sing it 5 years from now without paying me. If I could then prove that I had a written copy of that song from 5 years back it is still mine and I can then sue him for profits lost. Yes Apple owns the patent, however the patent really should mean nothing(why is this industry any different then another? )
Me and you could go back and forth on this matter for months; trust me i have spent hours on this debating with friends lol. I've done presentations to this effect(aimed at the ipad not so much smartphone's but the same theory stands)

I need to look into the creator siri thing you posted a little, I dont at all how patents are upheld if a creator moved(how many if you dont mind me asking; one, a few, all?) rules might change if a patent was not filed but I would think the IP is owned evenly by all creators of said program then. I could be wrong, I should ask around my office building we have tons of lawyers and a few judges.
Patents are sellable. Buy a company, you buy their patents also. HP recently sold a ton of patents they owned also related to Palm.
And comparing it to a song is not a good comparison. Copyright law and patent law are two completely different things. Copyright law (for the most part) operates with a lot more sense. If you can prove you produced the original work, you can obtain and keep the copyright (like everything in law there is exceptions.) But patent law is different. Patent law essentially allows you to copyright an idea before it's even created (to a point). About the only thing they share in common is that both require you to protect the patent or copyright with a reasonable amount of knowledge of your rights being infringed, and both can be sold. Copyright law also creates for things to become public domain after a certain amount of time unless granted special exemptions. (Disney just a few years ago was granted an exemption for the images of Mickey Mouse to extend beyond the normal period) Patents pretty much last forever. To this day Apple and Android makers still have to pay certain royalties for very basic telephony patents.
As I said, US Patent law is very retarded. It's never about who made what first or who created an idea. It's about who was smart enough to patent it first, and retain that patent. Also the US Patent office allows way to broad of patents sometimes, and those take years sometimes in courts to be refined. (Apple was granted a patent one time for rectangular phones...that broad)
The reason they have to sue about these...if somebody infringes on your patent and a judge decides you had reasonable knowledge of that infringement and decided not to pursue it, he could rule that patent null and void and open to everybody. The idea was created so you couldn't sit on a patent and wait for one or more large companies to infringe on it and then sue expecting a giant payday for something now common. So while we get upset about companies like Apple (and Motorola, Samsung, etc) making what seems like stupid law suits, most of the time its not because they really want to argue over petty stuff, it's because they have too.
Most of the hate about Apple and patents is because Apple essentially has a killer patent division. They are geniuses on getting and holding patents. I've read before that Apple will start looking into patents for stuff they have planned 50 years in the future.
Oh, and another reason I don't think Apple is worried, last I saw Apple still holds a very very strong lead in Retention over the android makers. And retention is always the #1 stat in business longevity. Something Apple does very well. People who buy Apple products almost always stay with apple for a very long time.

Point is Apple holds on to customers far better than the droid makers. The diversity of Android is just as much a problem as it is a benefit. Droid users are more apt to switch to the "hot new thing" regardless of brand. A Samsung user is easy to switch to HTC for example. It makes it hard for any one company to make a strong push to push out others. One of the main reasons why Apple really isn't scared. Sure, SIII is hot right now, but Apple phones will still sell insanely crazy. And 6 months from now the SIII will be old news, nobody will care, and something else will be the hot new droid. 6 months later iPhones have shown they are still as hot as the day they come out. Normally the only time Apple sees a significant drop in sales is right before announcement of the next phone.
So instead of making a new thread I'll just ask here since the phone is an Android. I just signed up with T-mobile and have an Amaze 4g, the phone is awesome but my dilemma is, I'm trying to connect it to the wifi in my house and every time I enter the code(yes it's in properly) it says the code is incorrect. It's the same code I use on my laptop and it works just fine /confuse

I get this message whenever i try to follow a link from facebook and 90% of the time it is followed by an oops something went wrong screen. it has made following any links form facebook virtually impossible and its fucking infuriating. anyone have any experience with it or know how to disable it? fucking boys just isnt getting the job done

Wanting to upgrade my DroidX soon to a new phone. How is the Razr Maxx? Also was wondering if i would have to repurchase everything or if that is just on my play store account for redownload?
Love the razr maxx, mostly because of the battery life. Thing will last over 2 days with moderate use for me, I went form a galaxy s2 skyrocket to the razor maxx and I do not regret it.
Well, minus the screen on the maxx is terrible compared to the galaxy s2 ones.

what are you looking for in a phone? The razr maxx is a great phone and all, but for me its pointless. I always have two battery's so its key selling point of *all day battery life* is wasted.
Id much rather have a phone that gives me 12~20 hours of life and haves a beast of a screen. for others its might be worth it. What im saying is depending on what you want it may or may not be for you.
and as ragnell said just re-download. unless your droid x is rooted(by the sound of it your not rooted) with titanium back up then just back everything up to your SD card and then fast upload them.
I agree with Dejet, I can't stand moto's screens and locked bootloaders etc anymore, HTC & samsung phones beat them in everything besides battery life
