Question about Car insurance and a paint job.

So just recently I noticed the paint coming off of my drivers side door handle on my 2007 Mazda RX-8. It almost looks like it had been replaced and instead of the entire door being repainted to be a uniform color they just did an overspray of the existing paint. Well the white plastic of the door handle is slowing showing thru and then now key marks are day by day revealing themselves around the key hole. I've never once stuck my key in there since I have my keyless entry.

Well when I took it up to the dealership I got it from they looked at it and totally agreed to what I thought it was too.. it was just oversprayed. Well they're saying I had it done that way so they wont repair it. Then I pointed at to them that my passenger door is fading at a lot faster rate than the rest of my car. Well they looked into that, they saw that my car had been rear ended recently and even tho the ONLY thing replaced was my trunk lid they told me that they couldnt warranty the paint job anymore, even on the doors...

when my trunk lid was replaced the body shop called me out there, the antenna wasnt sealed properly and literally rusted a hole thru my trunk lid and now Mazda is saying that they cant give me a new antenna, that the body show has to do it.. and I'm certainly not going to put the same rusted antenna back on my new trunk lid.

ok so now that the recap is all over, can I pay my deductible for my car insurance and have it repaired that way? It wasnt involved in an accident but I feel like im getting shafted after working so hard to afford my car, it wasnt cheap

Wow, that fucking sucks. I have no idea what insurance can do for you, the previous owner really fucked you over... the car was in an accident and you never knew? Was it a salvage title? Did you buy from a dealership or private? Sounds like you're kinda screwed either way... =/

If the vehicle is damaged due a previous owner then your insurance is not going to cover it...

    Put whose to say your not parked in a Walmart parking lot and have an inevitable encounter with a shopping cart? >:}

Just make sure filing a hit and run won't make your rates go higher. Some insurance companies do stuff like that.

Nope... When I bought it on Jan 1st 2008 it was claimed to be brand new. I was thinking it got damaged in shipment or on the lot

    It wasn't used

That's what really pisses me off, I would understand if it had been used and had this kinda stuff

And yeah I filed a hit and run when that kid backed into me, problem is they only fix the damaged panel. If we do it again then they'll just do the same, now that I think of it tho they don't send an adjuster out for minor damage. So I prolly could file something similar to the first time. Of course I'd rather go about it honestly and not commit fraud but I'm open to anything right now

Do you have it in writing that it was brand new? If you do then file a carfax.com report no matter what it costs you, think it's $30.00 or so? And see if the car has been in an accident. If it has and you got it on paper that it is supposedly 'brand new' then I think you need to contact a lawyer. Something sounds pretty damn shady.

And as for the Wal-Mart thing. Pretty simple to do. Up to you in the end whether you do it or not. A lot of stuff can go wrong really fast if you are not a great actor.

Well I live in a small town and my family owns the local movie theatre, the lady who does my insurance claims her daughter has worked for us for the passed three years so I should be able to slip that in under the radar prett easy since we're all friends.

And yeah I'm gonna get a carfax

Ok so I did a carfax before and when I did it showed 4 reports but w/o paying for it they don't tell you what they are. I know 1 is my accident but idk what the other three could be. What all kinda stuff do they report? Like are the three remaining reports accidents or could they be something else.

1 will be transfer of ownership from dealer to you, 1 will be your accident, it could be anything else from dispute in mileage to another accident

Yeah it doesn't have to be an accident for it to show on the report.

I'm sorry I made a mistake, I just did it again, it shows 7 reports for my car. I can't imagine a two yr old car having that many reports. When I get home I'm going to purchase it.

    1) transfer of title
    2) accident
    3) prolly initial inspection of car

    Still leaves four unaccounted for

If you haven't bought the Carfax report already, I recommend using AutoCheck instead. It's slightly less expensive, and tends to provide more detailed and thoroughly researched results. Though either one of these companies can miss something (as it's akin to obtaining credit checks from reporting companies), AutoCheck is generally better.

Yay!!! claim is in.. new paint job here I come.

After the fourth of July weekend some asshats in my apartment complex set off rockets too close to my car and I guess some of the burning wrappers landed on my hood and charred the paint so that was pretty much the final straw, my insurance company said they'd do it for me lol.

    Rule #1 of warranty service.

When dealership says no, contact the car company directly!

Dealerships will find anything to get out of warranty repairs. "OH your engine blew? Well you put on a different muffler, so were not gonna warranty it" kinda deal....

So give mazda customer service a call, tell them the situation and what the dealership told you........ and that it made no sense when a rear ending accident has nothing to do with the doors.

    Can't emphasize this enough.

GM tried to pull the same shit with my father. He had a Sunfire and the engine went to complete shit 20,000 Miles into ownership (he also had extended warranty).

Dealership tried to tell him b/c he missed one scheduled oil change by 200 miles, that he wasn't covered. Took 4-5 phone calls to GM, but he got his shit handled.

Call Mazda and ask them for the contact # to the regional Mazda Rep. You should be able to contact them about the claim.

Any of those reports are only going to tend to show things that got reported officially in some way. If, for example, your car had some severe lot damage and the dealer simply had their body shop/dent repair/etc take care of it, then it likely wouldn't show. If it was in an actual accident that was reported, then sure.

My parents had a van they bought new years ago. When they sold it, turns out, there was bondo in one of the side doors, despite them never having been in an accident in it. Kind of thing happens.

Was gonna say to check about simply getting the door resprayed, versus insurance fraud (few hundred bucks is cheap compared to legal fees), but it sounds like it's working out anyway =P

Also dont forget on carfax, it will also show if you had any "Major" maint. done to the car......... however, they claim major maint. could be a 15,000/30,000/45,000 mile tune up.

On the car fax report for my car it had:

-Date the Vehicle was Delivered to the first dealership
-Date the 1st owner bought it
-Date the 1st owner sold it
-Date the Dealership bought it at Auction
-Date the Dealership performed the 15,000 Maintenance
