    BG Legal team go. Question about rental lease.

    I was wondering if anyone knows about NYS tenant laws. I've read that it's up to the landlord to provide heat between certain months of the year (I.e end of fall to early spring), but I was wondering if you have electric heat in your apartment, and your lease says you have to pay utilities, does that put you in charge of paying for heat as well? It just seems like a loophole to me, or maybe im just not understanding it fully.

    Heat must be supplied from October 1 through May 31 to tenants in multiple dwellings. If the outdoor temperature falls below 55°F between the hours of six a.m. and ten p.m., each apartment must be heated to a temperature of at least 68°F. If the outdoor temperature falls below 40°F between the hours of ten p.m. and six a.m., each apartment must be heated to a temperature of at least 55°F. Multiple Dwelling Law § 79; Multiple Residence Law § 173; NYC Admin. Code § 27-2029.

    I'm planning to rent an apartment within a home, which is divided into 3 apartments. The guy wants me to sign a 1yr lease and I want to be able to cover myself fully before doing anything.

    It sounds like MA law........ so.....

    That law seems to cover the event of a broken heating system.

    The landlord needs to keep the house upto code with a working heating system, or not be able to rent out the house. It does not mean he has to pay for said heat. Just has to make sure the equipment will work as the law describes during that said timeframe, you have to make negotiations with the landlord as to who will actually pay for the heat.

    So the idea that since it electric heat, really shouldn't be considered a loophole if you have to pay the electric bill. Since he just has to make sure the heat system works to at least the described temperatures during said dates.

    Yeah, pretty sure it just means the "heating system has to be operational" not that the landlord has to pay for said heat.

    Ahhh gotcha, thanks for that clear up. Just got back from the place, not a bad 2 bedroom unit for $500/month. 15ftX15ft bedroom, 10ftX12ft bedroom, 10ftX10ft living room, 14ftX12ft kitchen and walk in bathroom with 2 porches.

    LULZ, I live in a really poor region and my family knows the guy so that's what made it possible. Not to say rent is too cheap up here, a lot of the homes are dissected up into 4 coffin apartments and landlords want 800/month for them. This guy owned a house his mother left to him, wasnt renting it or doing anything other then fixing it up for him and his wife to move into, but they cant sell their home down on Long Island so I stepped in and offered to rent it.

    This apartment must be nowhere near NYC to be at that price. I'm gonna ballpark it and guess the Rochester area?

    Amsterdam/Rotterdam region. Rochester is actually pretty pricey as well, not near what close to NYC is though.
