This was all about the food safety. She was shut down by health inspectors. At least that is what the OP said.
If you are selling food over a certain volume and in a public place like fair grounds you need a license and to comply to food safety rules regardless of how old you are.
Like it has been said before it is fine to set up a neighborhood lemonade stand where the volume will be small but it is not ok to go to a fair with a large volume of people and not expect to follow the same rules as everyone who is serving food.
People seem stuck on the $120, you can't just pay the $120 and get the permit you actually have to be inspected and show you meet food safety standards before they allow you to pay to get the permit. It isn't about the money it is about maintaining standards for any stand in a public place serving a large crowd food.
I have to agree with shutting her down at a festival. If it had been her family's front lawn then that would have been overboard. At a festival it looks more like the mother was running the stand and the little girl was being used as a shield to avoid paying fees. Silly thing all around though, the health inspectors had to know that it would cause a shit storm. Don't mess with little white girls.

I'd probably be more sympathetic if they were trying to brand a family recipe or something. Hell, even if the mom had borrowed a recipe from Martha Stewart it would have shown SOME semblance of effort. I do feel bad for the little girl only because it probably made her feel important to be handing out the stuff and I doubt she understands that her mother's own half-assery was at fault.

Edit: In case people can't follow my line of reasoning: There has never existed, in the history of the world, an event where a parent and a 7 year old daughter were engaged in an activity together that the child had 100% control of every step of the way and the parent was at the beck and call of the child. Doesn't matter what the child thinks the facts of the situation are, the deception is also the fault of the mother. Don't break the rules then point to your crying child who legitimately doesn't understand the situation and yell, "YOU DID THIS TO HER!" because, no, you did you fuckslosher.

If you read the original story from the Oregon news site that was linked on Drudge, the other vendors were on the kid+mom's side and told them to just stay after the inspector left.
