As much as you dont like the out come of the hit, if it was made ANYWHERE else along the boards, Pacioretty would be not nearly as hurt if at all. Thats just a fact.

Now debating if Chara was aware where he was on the ice and if he meant to do it, is a different debate.

The only reason Giles got hit with 10 games was that it was not only his first game back, but the first period where he left a borderline hit on someone. Giles now whether he likes it or not has a rep, and every hit he makes is going to be looked at with a magnifying glass till he retires or shows that he can play clean. Same was with Bertuzzi. He made a downright dirty hit on someone and ended his career. We are how many years past it and people still look at all his hits and wonder if it was dirty if it's even remotely questionable.

I still dont understand the relevance of this...if I check someone from behind on open ice instead of into the boards, theres no boards to break their neck...therefor checking from behind into the boards shouldnt be punishable since if the hit were open ice, there wouldnt be any problem, etc etc.

The fact that if the hit were elsewhere is irrelevant, its not about where the hit could have taken place, its about where the hit DID take place. Its about the fact that the game was 4-0 with the second period winding down and the Bruins were getting outplayed in every aspect of the game and are known to become goons when the game is over (see Lucic picking a fight with a non fighter with 2 minutes to go). It's about the fact that Chara has had beef towards Pacioretty. So once again, I dont think he woke up and said "I'm going to fuck this kid up today by ramming his head into the stansion", but I'm pretty certain when he saw who he was racing with against the boards and the placement they were going, he had a pretty good idea of his intention. Maybe he didnt plan for that extent of damage to be done...but you cant ignore the fact Chara has had beef with Pacioretty when trying to figure out what the fuck Chara was thinking when he did that.

The only reason its brought up is because of the outcome of the play.

And that is all that is being said. It would have been interference and nothing more, just like your example is it would have been a cross check and nothing more.

Basically it comes down to proving intent which is hard to do.

Its a tough call no matter how you look at it. I think he'll get 1-2 games at most but nothing as long as most people want.

Pretty hard to argue that he didn't shove his head into the boards/had intent to injure based on the film.

Moments ago, Zdeno Chara walked into the rink area at Ristuccia Arena, indicating that his disciplinary call has concluded. No word yet on any suspension.

In general it's the responsibility of the checker to ensure the safety of the check. So this whole nonsense about "only because of the outcome" is pretty irrelevant, because the checker is responsible for the outcome.

In delivering an obviously illegal check, Chara probably ended this guy's career. If that's not deserving of a long suspension, what is?

edit: also, Bertuzzi's attack should have been prosecuted as assault. Chara's hit at least was delivered within the spirit of the game.

MONTREAL – Jacques Martin met with the Montreal media after practice on Wednesday to give an update on Max Pacioretty’s condition after the young winger left Tuesday’s game following a hit by Zdneo Chara.

“Max Pacioretty has a severe concussion, as well as a fracture of the fourth cervical vertebrae, but it's not displaced,” explained Martin. “Max will remain at the hospital for further observation. There will be no other prognosis for the time being, but he will obviously be out indefinitely. The most important thing for our organization right now is Max’s recovery. We will continue following recommendations from the doctors and of course, Max and his immediate family would appreciate privacy in this matter.”

After a four-month investigation, the criminal justice branch of the British Columbia Ministry of the Attorney General announced on June 24, 2004, he being formally charged with assault causing bodily harm.[91] With the charge, Bertuzzi faced up to a-year-and-a-half in prison.[92] Several months later, on December 22, Bertuzzi pled guilty to the assault charge after arranging a plea bargain with prosecutors. Blame the prosecutors for offering such a lame deal. Subsequent civil lawsuits probably were a direct result of such a lenient punishment.

Wonder if the NHLPA will ever threaten any action if the NHL keeps avoiding supplementary discipline on hits where it's obviously necessary.
