    Well one thing on your side is that she will probably be reluctant to sue because..

    A) She started it(regardless of a case most people wont pursue this)
    B) Being a Christian woman it would look bad to her peers she is suing someone she tried to convert

    Point B is going to overshadow any thoughts about it.

    Its iffy.

    Since the officer did not arrest you for Assault and battery dangerous weapon (Foot to head), i'd say they pretty much sided with you via self defense.

    I wouldn't stress too much about it, go obtain a copy of the report from the responding PD and see what it says.

    You'll find out in 30 days weather or not she decides to press charges. That's usually how long it takes for the statute to expire for (simple) assault. Even then, she'll probably be discouraged from pressing charges since usually the responding commissioner will discourage it if it was a self defense thing (and it sounds like it to me).

    Also:

    She has a case if she pursues it. You used a higher amount of force than she did. Also, most people would not view a small Asian lady as a threat. Rule of thumb is, if someone hits you or threatens you, you can use an equivalent amount of force or threat of force. You roundhouse kicked her in the head, not sure that's equal.

    Although your vision was blurred and you were in a state of confusion, that doesn't matter.
    I would like to agree, however, that response you gave was a textbook law enforcement answer. In the civilian world, if you merely poked your finger in to my chest, that's assault and the appropriate response is to defend myself by whooping your ass, well so be it. Everyone remember the Youtube video (Amberlamps) where the old white guy beat the crap out of the black guy because the black dude slapped him? If I were a responding officer on that kind of scene, I wouldn't have taken any action as the instigator received the ultimate payback for trying to act like a hard ass.

    She has a case against you, just as you have one against her. However being that she's the old lady and you kicked her, chances are even with a countersuit you'll end up on the losing end.

    An off-the-path observation though - she is a fundie Christian, a "lamb of God" if you will. Which means there's a chance she'll live-and-let-live and you won't have to deal with a civil suit. Criminal charges would be a completely different matter, as the State is the authority on making the call. She could still ask that any charges be dropped though, if she wanted to be "nice"..

    I still don't see how people are looking at this as an "Old lady got hit? She'll win. She's an old lady!" issue. My Judo master is 85 years old on a cane and can't even walk more than 50 feet before he has to stop to rest and he'll still kick the shit out of guys beefier than the Governator. The fact of the matter is, age isn't an affirmative defense, especially if you're the aggressor.

    The REALLY funny bit would be if she was some ancient master martial arts bitch who converted to christianity in an attempt to atone for the 53 lives she took with her bare hands, and when you went to kick her, she deflected it, then smashed your supporting leg in the knee, before headbutting you in the balls.


    Also: when you train in karate in the future, make sure you use "ARE YOU READY FOR SOME FOOTBALL" as your kiai yell.

    She wasn't even an old lady though, she was probably in her 40s or something. The actual old lady that may actually have a case against me was the one the bitch fell on after taking the kick to the head, and she didn't even stick around for the police to come and took the next bus that came to the stop.

    I stood there, everything was blurry, perhaps the lady's strike has damaged my brain, or perhaps my lack of glasses turned everything into a blur, but before I knew it, my feet hits her on the side of the head, sending her back and causing her to fall on an old lady.

    Even if she could pursue a case against him, he'd be able to pursue one against her for assault as well.
