South Park was the first place I heard the song. The second place was on Tosh.0. never seen nor heard of it at all other than those 2 programs.
Now, I'm not saying they should sue or not sue, but it was obviously not a parody. Much of the video was left unchanged and they weren't making fun of the song, but using it to get laughs. If it gets taken to court I'd be willing to bet SP will lose. But they'll probably settle out of court.
I'm also interested in what jokes they stole from the collegehumor website.
It was the episode about Insheeption, where they pretty much verbatim'd the entire sketch. It would be interesting if a connection could be made between their videos and stolen internet videos - then it would make a great court case.
Still, with Samwell and the rest of the Youtubers I think it's more a matter of satire than it is blatant comedy theft.

Matt and Trey admitted to never actually seeing Inception but seeing the Parody on College Humor and assuming the movie was exactly like that. They lifted lines right from the Parody thinking that the Parody lifted lines right from the film. However unlike the "Brownmark" ass hats, there was no lawsuit or hard feelings involved.
On Tosh.0 the What-What guy said he was asked if they could use the song in an episode.
