    Upset Ebay Buying Question

    Here's the scenario:

    Dude selling two Asus monitors.

    I buy one with the buy it now feature for 275 free shipping.

    The other didn't even have the buy it now feature hence why I grabbed that one. Same one I am using but mine is busted on the right side and turning more and and more pink throughout the screen.

    That was Nov. 4th.

    He sends me a message saying he's waiting for the other to sell Nov 9th end time and that he'll send them out after it ends.

    I send him a reply saying I'm not happy about that but I'll deal.

    Obviously it's now Nov. 12 and I haven't even had WORD of shipment.

    I already overpaid by a lot as most are going for about 200. 230 after shipping.

    I contacted him again and in a polite way asked for a partial refund. I said that I overpaid for about $50 because I really did need it asap, but didn't quote what I'd actually like refunded, just kinda left it to him to assume.

    I know you can't really ship on Sat/Sun, but yea. That still left Thurs/Friday for him to get it out.

    Was this wrong?

    Can I go to Ebay?

    I want my fucking monitor, damn it.

    Nothing you can do until he breaks Ebay rules I don't think.
    Could try reporting him anyway, try something like saying he's acting suspicious and just want your money back.

    No other versions of this part monitor are up right now, so I'm pretty ticked.

    If it was this past Friday, that was Veteran's Day. Unlikely he could've shipped it that day.

    But yeah, you should be able to contact eBay in order to put pressure on him. You can also delineate what's happened in the seller's feedback.

    Buyers have 100% of the power on Ebay/Paypal; just do a chargeback and buy somewhere else.

    I got confirmation that he sent it, so I am going to wait to receive it as he did send it. He did not give me confirmation til I asked though. But it does say that he shipped it Friday. If it's not in 100% I am going to Ebay with it, though, I think.

    Well I would honestly slap him with either neutral or bad feedback. The point of Buy It Now is to get the product and not have to deal with the hassle of bidding and waiting for the auction to end. I sell things on eBay. The day after someone pays me their item is in the mail. But I'm apparently in the small minority of sellers that do this. Most people don't ship for 2 - 3 days on average. That being said, as a buyer you hold all the cards. Sellers are treated like second class citizens on eBay. They aren't able to even leave you neutral feedback, let alone bad. So I would say even if the item is in 100% flawless condition you still have grounds to leave him shit feedback. He didn't ask if it was alright to ship the item out that late. He told you what he was doing regardless of your thoughts on it. He was being lazy and wanted to save himself a trip to the post office. He could have listed the buy it now sale not expecting someone to buy it so quickly, maybe he didn't have the money to cover the shipping? Either way, not your problem or your fault.

    Honestly he sounds like a shady buyer. Don't be surprised if there's a problem with your item.

    To update:

    I opened a case with Ebay -- I just said what I said here. Seller "responded" with: Buyer was asked if a minor delay in shipping was acceptable (11/8/2011)
    after the Buy It Now feature was used. Buyer responded with confirmation
    (11/8/2011) of postponed delivery. Monitor is currently en route to Buyer's
    destination. Carrier selection was refined because of package size and
    weight. Shipping and handling remained gratis for the Buyer. This item
    (Item number:320786289922) will arrive on the date given by the Carrier
    (UPS Ground) (Carrier Tracking Number: 1Z865R3V0355493726). Prices provided
    via other auction end dates for identical products or other retailers from
    outside sites do not effect this auction's final sale. This party
    (freakk21) does not provide partial refunds for items purchased and will
    work with the seller (meiran) via the eBay messaging system to provide a
    full refund should the item become broken or damaged during shipment.

    He never did ask, though, he outright said he was waiting. It wasn't a question.

    I just escalated it to Ebay asking if I can return to sender via UPS online and get a full refund. Waiting to see what they say.

    OK, please advise BG:

    I contacted Ebay about putting in a return to sender and getting a refund.

    They said I should contact my CC service and ask about doing that and issuing a chargeback.

    I contacted my CC and they said that once they get confirmation that it's returned they can issue a chargeback if he doesn't refund within 15 business days.

    But, they were asking the question of "what was the refund policy" and I said if it was damaged I could send it back -- which is true. On the auction he claimed no refunds, but during the claim I put in it was said that

    " This party

    Well, in my opinion two weeks after buying it outright is damaged -- but will this hold up if I put in a return to sender now before it gets here and will they chargeback if he does NOT issue a refund?

    Personally, I've never ascribed any other meaning to 'damaged' besides 'broken' when it comes to goods. The monitor not being there likely won't qualify as damaged to most people. Slowly or never sent, yes. Damaged, probably not.

    Yea, unfortunately your kind of stuck there. I would have told him ship now or refund me my money and then gone after ebay if he refused.

    Your mistake was being honest with the CC. With Paypal transactions, just say it never arrived and they'll always believe you over Paypal/Ebay.

    to be honest, overpaid and/or agreeing to the later shipping date gives you zero case. You honestly are screwed, and doing a chargeback when they investigate your account could damage your ability to use ebay/paypal in the future. I know many sellers (like me) block people with recent bad chargebacks from being able to bid.

    Well here's the problem, the guy lied when he stated he asked you if a short delay in shipping was alright. If the item isn't damaged you might as well just suck it up and accept it as lesson learned. When you purchase on eBay you hold all the cards. Even after all this, the seller still won't be able to hit you with bad feedback. So I say give him both barrels just for being a douche.

    I swear Ebay brings out the retard in ways that only 4chan can believe. I'm selling extra blizzcon stuff from 09-10 and this guy in canada wins the auction for the 2010 loot card. Well due to ebay's policy's on part time sellers + scammers, there's no way i'm doing the whole scratch and email the code. Specifically stated shipping is mandatory. Guy wins the auction, sends me a message saying why haven't i received my code yet, and insists on me emailing it to him. So now he's talking to a friend about receiving the code for him. Going to have to secretly insure the item for myself if his friend accepts the shipment.
