They can upgrade you, but its very doubtful. My friends have tried to bring theirs in and got refurbs, but I guess I brought mine back just after their inventory turnover so they didn't have any available.

I've sent my iPod back to be replaced or refurbished twice now. It was functioning just fine before I sent it back in. I wanted to upgrade to the newer version of the iPod each time and didnt know what to do with the current one. So I just sent it back to Apple and they sent me a new refurbished one with a brand new serial code each time. I gifted them to friends and family.
All I did was say that the battery wouldn't hold a charge and that the harddrive was making a whirrrrrring sound. The last time I did it was a few months ago. My mom bought me an iPod Touch and I was using the iPod Video (Black). I had 6months left of my extended warranty (1.5 year old pod). I decided that I'd send it back in for a new one and give the results to my boyfriend who was using a nano.

Rocketfish is actually decent stuff. I got a PS from them and it turned out to be one of the better ones I have used lately (price was decent too). I hate Best Buy otherwise though, nothing like pulling something off the shelf with a giant hole in the box, only to see the product inside with a gaping hole in it (I've caught this 3 times), and they try to sell it to me anyways.
