    Discrimination at work?

I feel stupid even posting this but somethings gotta give.

Before anything, I'm suppose to be working fulltime at McDonald's. (just a placeholder til I get a new job... Pays college expenses at least)

Problem started a few months ago when we got a new supervisor, who is Mexican (shocking). When he was hired my hours fell from 40 a week to a little over 20 hours a week. At first it didn't bother me, however when I asked him why, he explained it's because we aren't as busy as we were before, which I understood.

Ever since then, he's hired over five new people, all of who are Mexican and have more hours than me. Two work fulltime.

Legally speaking, can I do anything about this?

call your HR department, also if you are classified as a full time employee i think he has to give you a minimum of 32 hours.

Can't do anything tbh. His motive isn't racial by any means, just sounds like he has a little personal bias which wouldn't hold up anywhere, or in court.

Also not just your location in specific. But all fast food chains (Especially McD's) follow a "refresh cycle" of hiring employees. They do this commonly to get in new people due to the high quit/hire rate, even during slow business quarters of the year.

Your best bet is to try to look for a better/advanced job opportunity if its available to you in your area.

    edit:

The FLSA does require, however, that overtime pay be paid after 40 hours of work in a workweek. This may be the reason many employers cap full-time employment at 40 hours per week.

Legally probably not, I'd talk to him and maybe have a tape recorder hidden on you just incase and bring up why your hours were cut, then 5 people were hired, 2 of which are working your old # of hours. If it's a bs reason then maybe go over his head and see if there's anything the higher ups can do.

If not get a job at Popeye's, shits way better.

Well, I believe you are technically entitled to 32 hours if (by paperwork) you are full-time. You can go above him on that if you are.

If not, start looking for another job. This guy is obviously biased.

Ultimately, unless you've signed anything stating you're a full-time worker, there isn't a whole lot you can do, because if the "full-time worker" contract was verbal, your boss can just claim it doesn't exist or that it doesn't apply because he wasn't involved in it, and at that point it's his word against yours. If you have signed something saying it, then your first action should be to speak with your boss, mentioning that you're entitled to a minimum number of hours per week, which isn't being met. If he refuses you, go above him on the corporate chain. If he tries to downsize you in response, file a grievance citing his large number of new workers.

If your "full-time" contract was entirely verbal (with your previous supervisor, no less), again you should speak with him about your number of hours and clearly state the issues. Give him your two weeks' notice at that point if you like, but be sure to be as courteous as possible because you want a good reference from him when you inevitably look for your next job.

Stated fulltime on my app if that matters. Also what would it mean if he told me he lost my original application. They keep all that shit in a drawer in the back, and I just confronted him about it.

If he's lying, the best thing to do is to be diplomatic about it. If there's a breach of contract involved, file a grievance. Don't be rude to him or anything, and don't make "I'm gonna do *" threats.

Also, if "stated fulltime on your app" means you said you were only looking for full-time employment, you're SOL because they'd have no obligation to meet this request. If they said they were looking for a full-time worker, then you have something to work with.

I'd be worried about him "losing" your app, honestly. Playing on stereotypes, but if he "lost" yours, then there's a chance he's "lost" the apps and info his little Mexican buddies, who might possibly be illegals.

Doesn't mcdonalds have a management tier system where you can contact a regional manager about the issues? There has to be a chain of command in such a large successful company where you can file complaints.

I feel stupid even posting this but somethings gotta give.

Before anything, I'm suppose to be working fulltime on the Normandy. (just a placeholder til I get a new assignment... Pays Alliance expenses at least)

Problem started a few months ago when we got a new technician, who is Quarian (shocking). When she was hired my hours fell from 40 a week to a little over 20 hours a week. At first it didn't bother me, however when I asked her why, she explained "It's because the ship is too quiet." The fuck?

Ever since then, she's hired over five new aliens, all of who are Quarian and have more hours than me. Two work fulltime in the engine room.

Legally speaking, can I shoot any of them?

If you don't have a contract you're pretty much screwed. Also, stating the number of hours doesn't dictate you're a full time worker, just states your availability. That's finalized once you sign the contract...

Try not to be confrontational because it's gonna get your ass fired. Instead you should talke to him and ask him: I noticed this and that, I need x hours for y reasons, is it possible to fill in the blank. If shit doesn't work, start looking for a new job.

Anyway, you get to see a lot of this type of shit everywhere. My supervisor gave preference to African Americans, I was lucky because she loved the fuck out of me. That and I was one of her favourite students :3
