Ebay Return/fraud question

So I bought the 5 GBA pokemon games from this seller in CA. Got the games in the mail today and found out all 5 are fake. Contacted the seller and told them they are fake, listed how i came to that conclusion and requested a refund + return shipping cost. He agreed and told me to let me know the shipping cost. Pretty sure hes just selling knock offs left and right now because he has 5 more listings for the exact same games but that beside the point. How does the return process go? I've never returned an item like this. Do I get the refund then ship back to him? Do I send to him then receive the refund when he receives the items back? Also sent me a message now offering for me to keep the games and him refund me $40 back (paid $51)

Report him to e-bay. They have a fraud protection team that handles that kind of things. If it was a good-faith sale that he believed they were real games and he bought off someone else, he might be able to slide. Most of the time they just revoke their seller privileges but if it keeps happening then they'll know what route they can take to file charges, especially if he doesn't make good on his offer to refund you.

I think more aptly this would fall under their Buyer Protection Policy. But yes, contact ebay before you send anything back, because if you send it back before they get involved and you don't get shipping refunded? They won't give a shit because they assume you made an agreement with the seller otherwise. Learned this lesson when I bought a $20 keyboard, got to me with malfunctioning keys, and had to bite $10 shipping because they refunded my paypal prior to getting to ebay about it.

You can report fraudulent listings. At the bottom of every auction there's a Report This Item link. Just go to every one of his auctions and report them. Or you can attempt to go through the three ring circus to call eBay directly. But you'll get a call center in India that won't do anything to help you. Leave the guy bad feedback and report that the games are fakes. A lot of people check feedback before buying(I know I do.)

Go through Ebay. Like people have said, this falls under Ebay's buyer protection policies. Don't bother dealing with the seller and just let Ebay handle it. You're pretty much guaranteed to recoup your money back.

Well you opened a case already so that's step one. If he already refunded the money leave him negative feedback saying games are fakes. Then go through and report his listings and put in the reason why. That's really all you can do. eBay isn't going to ban the guy unless they get multiple reports. Send me his user ID and I'll report the listings lol.

Ok so I receive the refund before sending the merchandise? No way in hell im taking a partial refund lol. The games are useless to me no way in hell im taking a 11 dollar hit on them

Yup. I would highlight to him the fact that he has already sold you fake games. Because of that you need your full refund before you ship them back to him. Explain that it's nothing personal. Regardless if he reneges on refunding you then you can escalate the problem further and eBay will issue a final ruling. Which is almost always in the buyer's favor so long as they are being reasonable.

It's not really that bad when it comes to buying shit. It's when you sell shit you can get monumentally fucked by scammers. Always put a tracking number on anything you send out. Period. Stops most scams right out the door. I've also started taking short videos of each item I sell going over the condition and saving it. I've managed to avoid being scammed three times on high priced sales because I did that. Buyers claimed the item wasn't as described and would show me a picture of the item in damaged condition demanding a partial or full refund. I send them the video of the item and how securely it was packed. Never heard from them again.

As for buying shit, I've only ever had issues with new sellers. They under describe or don't have a description of a game's condition at all. So when you see "Like New" in the condition and you get a disc scratched to shit with no manual or case it's a bit irritating.

Thanks for all the input. I emailed the seller requesting a refund + shipping before sending the items out. If he refuses i'll just let ebay handle it and let them tell me how to proceed.

Going by his name on ebay, he lives within 5 minutes of my work. If he fucks you over I can get you in contact with the county's fraud division Or I could knee cap him for you. Your choice.

Why is he bootlegging some old ass cartridges lol You can find tons of old nintendo cartridges out there to resell. Ebay is bad enough for legit sellers out there getting scammed or being fucked-with by competitors.
