Hmm, after looking some stuff up it seems likely that these men will be charged with some form of Involuntary Manslaughter on a Recklessness/Criminal Negligence count. From what I gather about the TV interview, one of the men has already demonstrated mens rea (guilty mind) by having some remorse through admitting to not helping her. Those guys are pretty fucked, as culpability won't be hard to establish. Hopefully they do the right thing and plead guilty and throw themselves on the mercy of the court to hope for a short sentence or plea bargain. But, if they're rich boys I'm betting that this will go through about four appeals before anything happens and the case is thrown out.

This reminds me a bit of the Reena Virk murder case here in my home town of Victoria, BC. Fourteen year-old Virk, a second-generation Indo-Canadian girl, was a social misfit and took an invitation to go party at a park near a bridge in a shitty part of town. While there she gets swarmed and beaten by 8 teenagers (7 girls, 1 boy) but was able to walk away after the beatings were stopped by someone there. However, two people from the beating group followed her, dragged her under the bridge (bridge was over a waterway), beat her more, and then Kelly Ellard forcibly kept her head under water until she stopped struggling. Virk washed up further down the Gorge Waterway a day or so later. The coroner's report indicated that she had died from drowning, though she had sustained skull fractures and other trauma that would have likely killed he had she not been immediately received medical attention.

Now, this is obviously a case of murder in the second degree, not merely criminal negligence. However, the youths that were part of the initial beating all got assault charges whereas the accomplice to Ellard (the only legal adult at the time of the murder) was charged with second-degree murder. Ellard has been charged with murder in the first degree, and even though she was a minor when the crime happened, she has subsequently been re-tried as an adult (and rightly so.) She's a fucking sociopath that Ellard. She's now on her fourth trial and every time she goes to court there's no emotion or anything when giving her testimony.

Interestingly though, in Canada attempted murder carries the same consequence as murder itself; the intent of the crime determines the penalty, not the actual result.
