So, i'm thinking about getting a ps3, but so far the only one I can find is the 40gb one.

I heard the 40gb one does not have any ps2 playback capibilities, so is there a way illegally to play ps2 games on your 40gb ps3?

No, my suggestion to you would be if the PS2 compatibility is even somewhat important to start calling stores in an expanding range and get ready to drive for a while.

Finding an 80GB one will be hard, they've discontinued it for now and plan to re-release it as a bundle with MGS4. I have no idea why, but Sony has done things like this before =/. Maybe look for a 60GB or 80GB PS3 online, and give an I.O.U. as a B-Day gift for tomorrow? The 40GB has no backwards compatibility at all unfortunately. Albeit, the 80GB uses emulation for PS2 games, so Sony could possibly release a patch or download in the future for 40GB owners. But thats just crazy speculation at this point.

I got the 80 gig motorstorm bundle as well, but motorstorm fucking sucks, and my PS3 has like 4 things wrong with it.

the 40gb cant be patched to play ps2 games ever. it is completely physically incapable of playing them.

20/60 gb had the ps2 chip(emotion engine) + ps2 graphics chip inside of them, thus being a ps2+ps3 in one really.

80gb has the ps2 graphics chip in it for rendering ps2 games and relies on emulation to cover the processing.

the 40gb has neither ps2 chip in it at all and cant play any ps2 games.

they all rely on software emulation to play ps1 games, hence why they all can.
