The mayor of Batman, Turkey, is suing Warner Bros. and The Dark Knight director Christopher Nolan for using the Cape Crusader's name without the city's permission.

Variety reports Huseyin Kalkan, mayor of the predominantly Kurdish town located in the Batman province of Turkey on the Batman River, is preparing to file a series of charges against Nolan and Warner Bros. for royalties from the blockbuster film.

"There is only one Batman in the world," Kalkan said. "The American producers used the name of our city without informing us."

He also hopes to pin a number of unsolved murders along with the town's female suicide rate on the psychological impact the film's success had on Batman residence, the publication said. (Why so serious?)

Kalkan claims to have evidence that will prove the city of Batman was founded before the 1939 debut of DC Comic's superhero by the same name.

Why the city is complaining now about its name being used for masked justice may have something to do with The Dark Knight having grossed over $994 million worldwide so far.

Of course, one could also speculate the city could have figured this out much sooner with the assistance of Batman, the world's greatest detective. Alas, therein lies the crux of the problem.

Warner Bros. said it hasn't been served with a lawsuit yet from Kalkan.

DC might be able to dodge this if they can provide sufficient evidence that they came up with the name independently of the Turkish city.

Now that I think of it, in terms of inventions, if two people come up with the same idea independently at the same time, and one patents it before the other, can the other still use it or does he have to respect the other patent despite having invented it all on their own? e.g. two companies coming up with the same technology independently, but one patents it and sues the other for using it, like with Vonage and Verizon (only assume Vonage came up with the technology on their own instead of stealing it from Verizon).

This would be trademarks, not patents, and they don't have a legal leg to stand on. You don't have to register trademarks, but if you don't, it's considered a "local" trademark, only applying to your local geographic region. Needless to say, Batman, Turkey does not have an international or US trademark registered. Trademarks also aren't necessarily based on who used the name first. For example, the Nissan auto company sued a guy named Uzi Nissan who ran a computer repair business with their family name. They won, and he was compelled to give up nissan.com to Nissan Motors despite having several decades of "seniority" with the name. Lastly, trademarks involving common words are generally on very shaky ground, they're usually limited to a single field or industry in order to prevent direct competitors from using the name to invoke confusion. It's really just a stupid publicity stunt that won't even make it to the courts. Patents are entirely different beasts, but yeah, if you can prove that you came up with something before the patent was filed, you may be able to get it invalidated. It's complicated, to put it mildly.
