NEW YORK (WABC) -- A man choked to death on a hot dog over the summer, but now the accident has been re-classified as a homicide.

The victim, a 65-year-old man, died when he suffered a seizure eating a hot dog at his apartment in Chelsea.

But now the Medical Examiner says Crawford's seizures were caused by an attack against him 44 years ago.

Back in July, 65-year-old Jimmie Crawford began choking in his Chelsea apartment.

Lifelong friend and neighbor Thomas Arneel ran across the hall to offer CPR.

"When I went to do that I opened up his mouth, I saw bread in his mouth so I started to take the bread out of his mouth," He said. Arneel adds, "Then I tried to turn him and I saw hot dog bread underneath him."

Crawford was eventually rushed to St. Vincent's Hospital where he was later pronounced dead. Apparently he choked to death on that hot dog.

But Monday in a shocking turn, the Medical Examiner ruled Crawford's death a homicide saying the cause was 'asphyxia due to neurological impairment following remote blunt impact of the head.'

Crawford reportedly sustained that trauma to his head 44 years ago in1965 when he was assaulted during an altercation in the village, near Charles street and Greenwhich avenue. It left him with a metal plate in his head.

So far, police aren't sure there's even a record of the decades old attack. and while Thomas Arneel remembers it, he doesn't think that killed his friend.

"I don't believe so. I believe if quick medical attention were there, he would have been alive," says Arneel.

There is generally an "ultimate cause of death" and a "proximate cause of death". For example, say you are a life time 2 pack a day smoker for 50 years. You develop lung cancer and are diagnosed at 65. Doctors put you on chemotherapy, which has a side effect of killing your immune system. You then develop bacterimia and die of sepsis in the hospital. Your "ultimate cause of death" is sepsis. Your "proximate cause of death" is smoking; it's what caused the cancer that force you to go on chemo, who's side effect shot your immune system to hell, that severely heightened your risk of the systemic infection that ultimately killed you. You basically work backwards from what most immediately killed you until you find the most basic underlying cause.

So for this, you could say his ultimate cause of death was lack of oxygen to the brain since he choked on the hotdog. But then you could ask did he just have bad luck and choked on the dog or was he predisposed to getting into a situation where he would choke because of some neurological issue he had? In this case, the examiner probably thought yes, then kept asking the cause and effect questions. So he had a neurological issue that predisposed him to a choking situation - how did he get it? Huge metal plate would be a big clue. He was attacked 40+ years ago? That's where he got it.

It's the "proximate cause of death", or the fact that he was attacked, that determines if something is homicide, suicide, natural, etc. Now this would only make sense if you could logically make the leap that his 'neurological condition' predisposed him to choking. But stuff like timeline is not supposed to affect the proximate cause of death.

My professor once joked that 100% of the time, the proximate cause of death is birth. Examiners can be pretty liberal with their cause and effect, but there are limitations. You obviously can't list everyone's proximate cause of death as their own birth; likewise you can't list everyone's ultimate cause of death that they simply stopped breathing. Doing so doesn't really help you qualify what happened. I'm sure there is a more exact science to this, but this case doesn't seem implausible imo.
