    Employer bouncing paychecks

    Okay so big things happening at my work as of late. I work at an Adult Foster Care company that houses adults who need 24 hour care. Now a little more backstory. About 3 weeks ago the owner of the company got in a serious car accident and is in intensive care in a coma. The problem with that is, is that the whole company(about 290 people) is held together by him. There is no second in charge and he did everything which included depositing money into the account people cash their checks from hence the bouncing of them. Right now no one in the company is being paid for overtime because he has to approve it and with checks bouncing I wonder if I will even be able to cash mine in 10 days when I get it. Now this company has been run very poorly. My training which is required by the state of Michigan is out of date for over 3 years and they are suppose to re-train me but haven't.

    Several people who got bounced checks this past payday are quitting and looking for another job. I'm wondering if legally this can be taken care of given the state of everything that is going on that they can transfer control to someone who can make the decisions or if this pattern continues that they will just go under when people start quitting left and right. I'm not too confident that it would stay afloat anyways because the person who would get control was my old boss and she needs a calculator to add 40+32(not kidding here). Also wondering if my check bounces what action I can take in legal terms against the company and if they go under will I ever get paid?

    You're basically fucked unless a family member of his steps up.

    There are methods to resolve this and transfer control to a temporary non-related corporate officer, but it will take so long that everyone will have jumped ship and left the company in shambles anyways.

    Start looking for a new job and just hope he comes out of the comma asap otherwise.

    Is the facility funded through or by medicaid and are the clients receiving care than is below standard?

    Not sure what exactly funds it as I never get to go to the office and whatnot but I'm sure medicaid is involved somehow. I personally think a lot of the clients are receiving below standard care or atleast borderline of that. They are usually given EXACTLY what they need and nothing more.

    Do you know if you are audited annually by medicaid? As a worker, I'd think the upper management would make a big deal out of it. It's usually one or two days of hell for the employees.

    your employer didn't have power of attorney documents or a living will? what the fuck kind of operation were you working at?

    Almost 300 employee company running the better half of 2 decades. The thing is he hired all friends and family to run the business and the only person with more then a highschool education is him in the ENTIRE company.

    290 is actually a pretty decent size for a single adult care facility. In most of the facilities, you are looking at ~8+ patients to a CNA, an entire floor to an RN, all swapping 10-12 hour shifts.

    I can't even begin to imagine how he managed to keep it running that long, without having enough foresight to plan for something like this.

    The fact this never came up in 20 years somehow astounds me. Honestly best advice for you is to find another job quick, try and get the check afterwards since the fault is on him

    Shit happens though, I'm honestly surprised that in 20 years there has never been a situation where the boss couldnt be there to sign checks and thought maybe he'd need to give someone else authority to do it in his absence. My old job at my dad's ghetto taxi service in Brooklyn only had like 10 people on payroll and we had 2 people to sign checks.

    actually, the boss doesn't owe you money, that corporation does. Legally it's two different people.

    Check your state's labor laws. Bounced check fees, overtime payments. You can seriously cash in here.

    Ok fine, so the issue isn't that people couldn't get checks cause he was dumb and didn't have another person authorized to sign them, but that people couldn't get paid cause he was dumb and didn't have another person authorized to deposit money into the accounts.

    Stupid shit is stupid. In the 2 offices I worked at, there was 1 guy who would mainly handle deposits and sign, the president could handle it if need be, and a 3rd person who could handle it incase both were literally dead in an explosion and the lawyer needed to be called. 1 was a ghetto car company run by immigrants, I dunno how a company with 300 people can somehow be worse off.

    unless the owner used company profits to pay personal expenses, instead of just assigning himself a salary, no he isnt liable for anything.
