    A Delaware man convicted of raping his three-year-old daughter only faced probation after a state Superior Court judge ruled he "will not fare well" in prison.

    In her decision, Judge Jan Jurden suggested Robert H. Richards IV would benefit more from treatment. Richards, who was charged with fourth-degree rape in 2009, is an unemployed heir living off his trust fund. The light sentence has only became public as the result of a subsequent lawsuit filed by his ex-wife, which charges that he penetrated his daughter with his fingers while masturbating, and subsequently assaulted his son as well.

    Richards is the great grandson of du Pont family patriarch Irenee du Pont, a chemical baron.

    According to the lawsuit filed by Richards' ex-wife, he admitted to assaulting his infant son in addition to his daughter between 2005 and 2007. Richards was initially indicted on two counts of second-degree child rape, felonies that translate to a 10-year mandatory jail sentence per count. He was released on $60,000 bail while awaiting his charges.

    Richards hired one of the state's top law firms and was offered a plea deal of one count of fourth-degree rape charges -- which carries no mandatory minimum prison sentencing. He accepted, and admitted to the assault.

    In her sentence, Jurden said he would benefit from participating in a sex offenders rehabilitation program rather than serving prison time.

    Delaware Public Defender Brendan J. O'Neill told The News Journal that it was "extremely rare" for an individual to fare well in prison. "Prison is to punish, to segregate the offender from society, and the notion that prison serves people well hasn't proven to be true in most circumstances," he said, adding that the light sentence for the member of the one percent raised questions about “how a person with great wealth may be treated by the system.” (Though perhaps it provides more answers than questions.)

    According to the The News Journal, several attorneys claimed treatment over jail time was a deal more typically granted to drug addicts, not sex offenders.

    Kendall Marlowe, executive director of the National Association for Counsel for Children, told The News Journal that sex offenders are jailed for the safety of the children they threaten.

    "Child protection laws are there to safeguard children, and adults who knowingly harm children should be punished," she said. "Our prisons should be more rehabilitative environments, but the prison system's inadequacies are not a justification for letting a child molester off the hook."

    News of the lenient sentence for the confessed rapist comes as a new book, Thomas Piketty's Capitalism In The 21st Century, has put new focus on the distorting role of inheritance in the free market economy

    Dude is rich as shit, like he WASN'T going to some min security prison to begin with where he could brush up on his racket ball. None of this should come as any surprise though, rich always get off. More money you got, the heavier the crime you can commit.

    Any info on what the potential sentences are for 4th degree rape? If it's a max of like 1-2 years, then yeah, rehabilitation would probably be better. If you aren't going to lock someone up forever, rehab will (generally speaking) be more useful than a short prison stint. His financial situation doesn't change that fact, although the argument could be made that an unemployed well-to-do heir isn't contributing shit to society anyway, but then prison would kind of guarantee he doesn't ever.

    That said, most likely the only reason he admitted it and plead guilty is because his lawyers knew he would get this kind of a cushy sentencing, making it the smart move. In a case like this, there's virtually no way to prove guilt unless someone breaks down and admits it during a lawful interrogation (or on the witness stand).

    Fourth-degree rape is a Class C violent felony that under Delaware law can bring a sentence of up to 15 years in prison, but does not carry a mandatory minimum sentence. Sentencing guidelines used by judges and lawyers call for up to 30 months in prison.

    Ah, so up to 15 years if judges feel like being dicks, but would probably have been about 1-2.5 years based on sentencing guidelines. Yeah, I have no problem with the rehab in that case. I just wish that judges would do this across the board. Pretty bullshit that ordering rehab instead of prison would never happen if the dude were black and/or poor.

    I found it pretty suspect as well. If they had any evidence whatsoever beyond the ex-wife's accusation, they would've nailed this guy to the wall instead of offering him some golden plea deal. Even money doesn't make it ok to rape babies. That's off the charts fucked up. And obviously ex-wives have motive to lie (don't let this baby raper take my kids, and oh btw, child support plzkthx), and rich guys have motive to lie (sure I'll say I'm a baby raper if it doesn't unduly inconvenience me and keeps me out of national headlines).

    The lawsuit the ex-wife filed is a civil suit. She's using the fact that he accepted the plea deal and admitted guilt against him to try to get money. Do you think there really aren't people that would lie and accept a plea deal when they think it's the best option, and their lawyers advise them to do so, even if they're 100% innocent? Happens every damn day, man.

    Also, not sure why what I wrote was scary.

    Take out the baby and a very similar thing just went down on the Vine app with 2 of the more famous viners. He took plea and admitted guilt to felony assault on a woman instead of going to trial.

    Thing is, I'm accused of rape or anything and I'm innocent, I'm going down doing everything I can to clear my name, courtroom trials or not, national headlines etc, what the fuck ever. I'm sure as fuck not going to plea and admit to shit I didn't do, when it comes to something like this.

    Both cases the guy seems pretty fucking guilty to me.

    Even if he's innocent, not worth my personal karma, morals etc to sit here and try to think of hypothetical reasons why he might be innocent. I'd rather be wrong on the right side of the fight nawmeanhomie.

    You're absolutely convinced in every single case, despite monumental evidence and/or admissions of guilt, it was somehow coerced by the court or law enforcement. Your opinion here means nothing, you're a sick-minded individual and have displayed as such on numerous occassions here in BG.

    I've testifited countless times in sexual assault cases on what exactly the subject told me and there's one constant in every single case I've dealt with, no one admits to shit they didn't do without some basis of truth.
