Friend wants to leave home (18 years old)

Looking for people who know shit about THE LAW!

My friend is 18 years old and she wants to move out of her house because her mom is a complete lunatic and she (in my opinion and many others) is not fit mentally to be a parent. I will try to stay away from background unless it's necessary.

I keep reading that in the state of Alabama the "Age of majority" is set at 19. I don't really know what this means but it sounds like it could hinder my friend from being able to leave. Reason being, because her mom will seriously freak the fuck out and go to the police and do everything she can to drag her daughter back home.

This is the official "Code of Alabama" site and I've linked it to where I'm questioning.

    Code Of Alabama

    (7) MISSING PERSON. A person 18 years old or older whose disappearance is possibly not voluntary.
Does this mean if an 18 year old whose disappearance WAS voluntary, nothing can be done? There's not much explanation from those 'definitions'.

Any feedback would be appreciated. Thanks ^^

a more specific link would be nice, and i'm not sure why you quoted what you did, according to the text you quoted she could be 86 and it would still apply to her..

Means she has to wait til 19.

Move to a different state where the law is 18?

    Or is that not possible?

Well no, I mean, if she up and leaves and moves to a different state is she still under Alabama jurisdiction or the new state's? I don't know much about the law, admittedly, but if the woman is such a bad parent will she really freak out and even care?

    There's always Mexico I guess >.>

Just tell her to say in school, or do some after school programs + find a part-time job to save money. The point is that she needs to stay under the radar as much as she can. Then she can move out when she's 19 and she'll have money; and of course a better idea of what things she'll have to deal when she's independent. That'd be the smart thing to do, but people her age aren't smart. She'll probably end up in a strip club ;x

Nah, hope everything turns out fine.

If the mother is indeed "mentally unstable" and not fit to be a parent as you put it, then your friend (can;t ever help but think ever time someone has "a friend" it's really themselves!) could then, I believe they could go to court and (dont know the technical term for it) divorce your parents, meaning they would have no authority over them.

To elaborate on the post above, you can specifically seek out emancipation.

If her mom isn't totally control freak batshit crazy tell her to do what the others are saying and get a job. Rent sucks, and if she can't support herself right now better to grin and bear it (since we dont know what 'it' is) than to be homeless.

Since you don't want to go into details as to why she wants out of her home, how about telling us what her plans where if she could? That way we can give advice on that as well (since as other people have said, 18 isn't the brightest about the world no matter who you are)

If im not mistaken turning 19 absolves your parents of any responsibility. which means if you arent in school are not responsible for health insurance and basic needs. if you are in school its usually extended. i believe this is the case for purposes of taxation and claiming an individual. in NY you are connected to your parents w-2s for college until you turn 24 i believe. so until you turn 24 you are covered by your parents health insurance.

at 18 you are considered an adult in the US. by which i mean you can vote and enter into legal contracts. your parents do have responsibility for you but it only extends to a very slight degree.

    only thing that i found relating to adulthood is;

    30A-1-4
    13A-12-193
    13A-12-193
    13A-12-197
    13A-12-191

these involve age of legal consent in regard to marriage and child porn. if your friend is still iffy on these things you should really go to your town court and ask to speak with someone on the matter. they will be the ones who will have the definite answers you seek.

i remember leaving my parents at 16. they called the cops who showed up to my job and told me they couldnt force me but could ask nicely for me to return home and talk to my father. it boiled down to liability, my dad was liable for my well being but not my actions any longer.

same with a friend he was thrown out and sued his father. his father instead of letting him back in was required to send him a check to cover his rent, food, clothing and keep him insured.

also unrelated but i found this to be just awesome

There is a law specifically outlawing wrestling with bears. That's awesome.

Moving out now without her being able to financial support herself WILL ruin her life. Don't let that happen.

That road only ends in heroine addiction and her changing her name to "Diamond". Get a job, go to school, hang out at a friend's house, get a boyfriend, push some weight, etc.

Tell her to join the armed forces. Instant emancipation.
