    Question for the BG legal team, involving drunk driving accident.

    Question for anyone that knows or has had this happen to them. My gf was in an accident around September of last year, drunk driver hit her and her sister head on in Maryland. Her sister suffered a sprained knee, my gf on the other hand suffered lung punctures and broken ribs, along with the psychological stress of it all. She can no longer drive on long highways because she ends up having panic attacks.

    She just had her lawyer call to tell her what the final settlement is, according to the lawyer she will get around 4k total after having to pay the lawyer, hospital bills and health insurance. Up here in NY we have No Fault where the car insurance has to pay for the injury in an accident, and when that insurance is maxed it goes to the other cars insurance afterwards, does anyone know if ML has that policy? Her sister is getting upwards of 15k for her injury, 10k after paying the lawyer and the bill for her knee. In my eyes something is fucked up here, but i'm not sure if it's just "lol health insurance" system at work or if the lawyer isnt doing all she can. I told my gf to contact another lawyer for a second opinion but since its friday and she has work till 7 she won't be able to.

    So anyone been in a situation like this? I think 4k is kind of a shitty payout when the guy that hit her was beyond intoxicated, admitted it in open court that he was drunk while driving and supposedly ML has a nasty policy towards DUI cases.

    Well treating broken ribs and a punctured lung costs a shit ton more than a sprained knee, maybe thats were all the money went? I dunno, she probably should sue the drunk driver for psychological damage or someshit.

    That sounds like the insurance company trying to lowball a settlement. Push for at least 35k each above & beyond legal & medical bills.

    Yeah, her lawyer said that the settlement won't go any higher then I think, 20k but that's including all the bills and legal fees and everything. I think she just has a shit ass lawyer who isn't doing half of what they should be.


    Now can she sue the dead after the settlement for the accident? I've seen her try to drive a few times, she ends up breaking down and crying on highways or stressing the fuck out. Not sure what all they would check on a lawsuit involving emotional damage. She drives to work each day, but its because she's known the roads for 10yrs and they are all 1-2lane backroads.

    Another question, if the insurance is lowballing her and won't budge to go higher. Should she just take him to open court with a jury?

    Her lawyer is trying to make a quick buck by getting her to take the settlement. No way is that anywhere near what she can actually get.

    Fire the douche and get a good lawyer. My mom got hit by a Frontier (phone company) Truck that ran a stop sign.

    Frontier Insurance paid out for the car, her pain and suffering, reimbursed for all medical bills and insurance deductibles related to the accident, and they also paid my dad b/c my mom was unable to perform her wifely duties.

    She had slipped disks, nerve damage, etc. They pocketed near a million, if not a little more than that.

    At the beginning of the whole deal their insurance wanted to settle for fucking 10 grand
    for soft tissue damage.

    Yeah, was talking to my mom and apparently my stepfather works with a guy who got 50k from a subjective claim. He claimed his neck was hurt but had no documents to prove it. My gf has all of the hospital bills and doctor notes to prove her pain and suffering claim, not even counting the subjective claim of PTSD as a result of the accident.

    The PTSD is what they are most afraid of. She should attempt to see a psychologist just so that she has that in her back pocket as well. Don't go with 4k. That's an insult. If it's their first offer, don't worry it's going to go up. They do not want to go to court over this.

    It's their 2nd offer, the first was even lower, like 10k total not counting bills+fee

    4k isn't enough close to enough to pay for all the hard drinking it'll take to get over it. After 20 years of seeing my brother drown in a lake I still have serious issues of being near water I can't see the bottom of.

    So apparently the lawyer is going to make 9k off the settlement and I was wrong about how much the gf will get. It will be about 7k. That just tells me something is fucked up. Apparently her lawyer is acting like it's some huge ordeal to even do paperwork or talk to the insurance company on my gf's behalf. So basically she wants to get her 9k, drop my gf and go on her way instead of doing her job. Hopefully finding a new lawyer for her on Monday. I've told her not to accept anything w/o a second opinion at the very least.

    She was laid up in the hospital for only 5 days as well. No way her healthcare costs went over 50k, which I believe is the cap that the insurance has to pay up to for an accident.

    Lawyer's goign to get more than your gf? Yeah, somethings very wrong right there. Tell the lawyer to fuck off and that you'll find someone who'll actually do the job they're being hired for.

    After reading you are in NY, we have MANY MANY shitty lawyers here. You have so much evidence on your side it's not even funny, 7k at the end is nothing. It's going to cost your girlfriend more than 7k in therapy fees considering it's been over half a year and she's still scared to drive, don't settle for that at all.

    The lawyer is just trying to see this as an opportunity to make a quick buck, and if you didn't have all the documents you claim you do it might be an attractive offer. Get whatever information you left at the lawyers that you need to ASAP, drop them and find a different one who will do your gf right.

    Well the GF is in Maryland and that's where she's living right now. So that's where her lawyer is from. But yeah I know from personal situations that lawyers up here suck lol.

    Get a new layer. Head on collision from an asshole who never deserved to be at in the wheel in the first place. Psychological stress that will require therapy, along with puctured lungs and broken ribs? 4k? get the hell out of here. Get a new lawyer asap.

    what's most likely happening is that the other driver had the state minimum, and the insurance company is paying out the max that the insured who hit you has. Your sister prob picked an ambulance chaser lawyer, they are terrible.

    Could you expand upon that Zig? What do you mean by state minimum? Or about paying out the max insured?


    Correct me if i'm wrong but doesnt the guy's insurance have to pay w/e a jury would decide would be acceptable if this goes into open court?
